According to article 8 of the Federal Law of February 9, 2007 N 16-FZ "About transport safety" (The Russian Federation Code, 2007, N 7 (part 1), Art. 837; 2008, N 30 (part 2), Art. 3616; 2009, N 29, Art. 3634; 2010, N 27, 3415) I order to the Art.:

Approve the enclosed Requirements for ensuring transport safety considering safety levels for different categories of objects of transport infrastructure and vehicles of road transport and road economy.

Requirements for ensuring transport safety the considering safety levels for different categories of objects of transport infrastructure and vehicles of road transport and road economy

I. Road economy

1. The requirements for ensuring transport safety considering safety levels for different categories of objects of transport infrastructure of road economy (further - Requirements), are developed according to article 8 of the Federal Law of February 9, 2007 N 16-FZ "About transport safety" (The Russian Federation Code, 2007, N 7, part 1, Art. 837; 2008, N 30, part 2, Art. 3616, 2009, N 29, Art. 3634, 2010, N 27, Art. 3415).

2. Requirements determine system of the measures realized by subjects of transport infrastructure for protection of objects of transport infrastructure of road economy (further - OTI) from potential, direct and direct hazards of making of acts of illegal intervention (further - ANV).

3. Requirements are applied to OTI operated by subjects of transport infrastructure in the territory of the Russian Federation.

4. Requirements are obligatory for execution by all subjects of transport infrastructure and extend on all legal entities and/or physical person which are on OTI.

5. The subject of transport infrastructure shall:

5.1. Designate person responsible for ensuring transport safety in the subject of transport infrastructure.

5.2. Appoint the official responsible for ensuring transport safety of OTI on each OTI of the first, second or third category.

5.3. Designate on each OTI person holding position on OTI responsible for ensuring transport safety.

5.4. Designate person responsible for ensuring transport safety of one or the OTI group of the fourth category.

5.5. Form (to create) according to singular authorized problems and/or attract according to plans of ensuring transport safety of division of transport safety to protection of OTI against acts of illegal intervention, including the rapid response teams which - are specially equipped, the mobile, round the clock carrying out tasks on response to preparation of making or making of ANV in zone of transport safety and/or on the OTI critical elements, and also on violations of the inside and throughput regime of group of number of persons employed of divisions of transport safety.

5.6. Develop, accept and perform the internal organizational and administrative documents directed to implementation of measures for ensuring transport safety of OTI and which are appendix to the plan of ensuring transport safety of OTI including:

5.6.1. Provision (charter) of divisions of transport safety of OTI of the subject of transport infrastructure (in the presence of such divisions).

5.6.2. Organizational and regular management structure in the subject of transport infrastructure.

5.6.3. The nomenclature (list) of positions of the workers of the subject of transport infrastructure (further - personnel) performing activities in zone of transport safety and on the OTI critical elements.

5.6.4. The nomenclature (list) of positions of the personnel which are directly connected with ensuring transport safety of OTI.

5.6.5. The nomenclature (list) of positions of personnel of the legal entities performing on legal causes activities in zone of transport safety or on the OTI critical elements.

5.6.6. Regulations (instruction) on the access and inside control on OTI.

5.6.7. Procedure for identification and recognition at check-points (posts) or on vehicles of the physical persons which do not have legal basis on pass and/or journey to zone of transport safety or on the OTI critical elements and also objects and substances which are prohibited or limited for moving to zone of transport safety and on the OTI critical elements in accordance with the legislation of the Russian Federation (further - objects and substances which are prohibited or limited for movement).

5.6.8. Procedure for test of documents, observations, interviews with physical persons and the estimates of these technical systems and means of ensuring of transport safety performed for identification of preparation for making of ANV or making of ANV concerning OTI.

5.6.9. Procedure for reaction of persons responsible for ensuring transport safety and the personnel which are directly connected with ensuring transport safety of OTI, and also divisions of transport safety (further - forces of ensuring transport safety) on preparation for making of ANV or making of ANV concerning OTI.

5.6.10. Procedure for informing competent authority in the field of ensuring transport safety and authorized divisions of federal executive body in the field of safety of the Russian Federation, the federal executive body performing functions on development of state policy and normative legal regulation in the field of internal affairs, and also territorial administration of the federal executive body performing functions on control and supervision in the field of transport about direct, direct threats and the facts of making of ANV in activities of OTI.

5.6.11. Procedure for bringing to forces of ensuring transport safety of information on change of levels of safety, and also response to such information.

5.6.12. Procedure for functioning of technical systems of ensuring transport safety, including procedure for data transmission from such systems, to authorized divisions of federal executive body in the field of safety of the Russian Federation, the federal executive body performing functions on development of state policy and normative legal regulation in the field of internal affairs, and also territorial administration of the federal executive body performing functions on control and supervision in the field of transport (further - procedure for data transmission from technical systems).

5.7. Provide evaluating vulnerability of OTI and approval in accordance with the established procedure of results of assessment of vulnerability of OTI within three months from the moment of receipt of the notification on inclusion of OTI in the Register of categorized OTI and about the appropriated category OTI.

5.8. Develop and approve the plan of ensuring transport safety of OTI within three months and realize it within six months from the moment of approval of results of assessment of vulnerability of OTI.

5.9. Develop, approve and realize order of interaction between forces of ensuring transport safety of OTI and forces of ensuring transport safety of other OTI with which there is technological interaction.

5.10. Check employees of forces of ensuring transport safety for the purpose of identification of the bases provided by part 1 of article 10 of the Federal Law of February 9, 2007 N 16-FZ "About transport safety" for the termination of employment relationships or refusal in employment.

5.11. Refuse employment to persons applying for holding the posts, directly connected with ensuring transport safety and stop employment relationships with persons holding such positions if concerning these persons the circumstances specifying discrepancy to requirements according to part 1 of article 10 of the Federal Law of February 9, 2007 N 16-FZ "About transport safety" will be revealed.

5.12. Perform special professional training, advanced training, retraining of employees of forces of ensuring transport safety according to the programs and documents determined by the legislation of the Russian Federation.

5.13. Allow to work on the positions specified in the nomenclature (list) of positions, the personnel which are directly connected with ensuring transport safety of OTI and also involve in fulfillment of duties on protection of OTI against acts of illegal intervention according to plans of ensuring transport safety only employees of forces of ensuring transport safety certified in accordance with the legislation of the Russian Federation.

5.14. Inform in evident and available form of all physical persons which are on OTI, and also the legal entities performing on them any types of activity, of requirements of the legislation on transport safety and the internal organizational and administrative documents directed to implementation of measures for ensuring transport safety of OTI, in the part concerning them including prohibition:

5.14.1. Pass (journey) to zones of transport safety out of the check point or without observance of conditions of the admission.

5.14.2. Transportations according to counterfeit (false) and/or invalid travel cards, transportation and/or to identification documents.

5.14.3. Bringing (transportation) of objects and/or substances which are prohibited or limited for moving to zone of transport safety and zone of open entry of OTI, and also about objects and substances which are prohibited or limited for movement.

5.14.4. Making of ANV concerning OTI, and also other actions leading to damage of devices and the equipment of OTI or their use not on functional purpose, involving the human victims, material damage or possibility of approach of such effects.

5.15. Carry out as independently, and with participation of representatives of federal executive bodies according to their competence, doctrines and trainings on implementation of plans of ensuring transport safety with frequency at least once a year for OTI of the third and fourth categories and at least two times a year for OTI of the first and second categories.

5.16. Inform competent authority in the field of ensuring transport safety of OTI in six months until change of structural or technical elements, engineering procedures on OTI which are the bases for change of value of the appropriated category, plans of ensuring transport safety and (or) need of carrying out additional assessment of vulnerability of OTI.

5.17. Change structural or technical elements, engineering procedures to OTI, and also procedure for their operation, only after acceptance by competent authority in the field of ensuring transport safety of the decision on availability or lack of need of change of value of the appropriated category, carrying out additional assessment of vulnerability of OTI and entering of amendments into plans of ensuring transport safety of OTI regarding concerning the made changes.

5.18. Without delay to inform competent authority in the field of ensuring transport safety and authorized divisions of federal executive body in the field of safety of the Russian Federation, the federal executive body performing functions on development of state policy and normative legal regulation in the field of internal affairs and also territorial administrations of the federal executive body performing functions on control and supervision in the field of transport about threats of making and/or making of ANV in activities of OTI.

5.19. Limit access to data on results of the carried-out assessment of vulnerability to OTI and plans of ensuring transport safety of OTI, in accordance with the legislation of the Russian Federation.

5.20. Realize the ensuring transport safety of OTI provided by the plan additional measures, in case of change of level of safety in the terms which are not exceeding: twelve hours for OTI of the fourth and third category, six hours for OTI of the second category and three hours for OTI of the first category, from the moment of obtaining, the message or decision making about change of level of safety.

5.21. Allocate for OTI and equip according to the approved plans of ensuring transport safety certain rooms or the allocated sites of rooms for management of technical systems and forces of ensuring transport safety - posts (Items) of management of ensuring transport safety in stationary and (or) mobile option.

5.22. Create and equip posts (Items) of management of ensuring transport safety with the necessary controls and bonds providing interaction as between forces of ensuring transport safety of OTI, and with forces of ensuring transport safety of other OTI with which there is technological interaction.

5.23. Provide the round-the-clock continued operation of posts (Items) of management of ensuring transport safety of OTI, and also accumulating, processing and storage in electronic form of data from all technical means of ensuring transport safety and transfer of the specified data according to established procedure, to authorized divisions of federal executive body in the field of safety of the Russian Federation, the federal executive body performing functions on development of state policy and normative legal regulation in the field of internal affairs and also territorial administrations of the federal executive body performing functions on control and supervision in the field of transport according to the approved plans of ensuring transport safety.

5.24. Provide video surveillance behind actions of forces of transport safety at the check point and posts (Items) of management of ensuring transport safety of OTI.

5.25. Establish for the purpose of ensuring transport safety:

5.25.1. Configuration and borders of the territory of OTI, access to which physical persons, the bringing (transportation) of material objects is not limited (further - zone of open entry of OTI).

5.25.2. Configuration and borders of the territory or part (land, underground, air, surface, underwater) OTI, pass to which is performed through check-points (posts) (daleezona of transport safety), and also the OTI critical elements.

5.25.3. Configuration and borders of sites of zone of transport safety of OTI, the admission of physical persons and movement of material objects in which it is performed according to carriage documents and/or omissions of the established types according to nomenclatures (lists) of positions and objects and substances which are prohibited or limited for movement (further - the transportation sector of zone of transport safety).

5.25.4. Configuration and borders of sites of zone of transport safety of OTI, access to which is limited for passengers and it is performed for physical persons and material objects according to omissions of the established types according to nomenclatures (lists) of positions and objects and substances which are prohibited or limited for movement (further - the technological sector of zone of transport safety).

5.25.5. The scheme of placement and structure of equipment of check-points (posts) on borders of the safety area and/or its sectors, the OTI critical elements, and also zones of open entry of OTI.

5.26. Change configuration and borders of zone of transport safety, its transportation and technological sectors and the OTI critical elements, and also the scheme of placement and structure of equipment of the check point only after completion of additional assessment of vulnerability and approval of the plans of ensuring transport safety considering such changes.

5.27. Organize the throughput and inside modes on OTI according to the internal organizational and administrative documents of the subject of transport infrastructure directed to implementation of measures for ensuring transport safety of OTI, and approved by plans of ensuring transport safety.

5.28. Prevent penetration of any persons into zone of transport safety or on the OTI critical elements out of the established (designated) check-points (posts).

5.29. Prevent overcoming check-points (posts) by any persons without observance of conditions of the admission, availability and validity of omissions and other established types of permissions in zone of transport safety or on the OTI critical elements.

5.30. Establish the single types of omissions valid for pass, journey of physical persons or moving of material objects to transportation and/or technological sectors of zone of transport safety and/or on the OTI critical elements, and also rules of their application, destruction of omissions and the admission of owners according to the following procedure:
