of March 25, 2010 No. 431

About approval of the technical regulation of the Republic of Belarus "Milk and dairy products. Safety" (TP 2010/018/BY)

According to the paragraph the sixth article 8 of the Law of the Republic of Belarus of January 5, 2004 "About technical regulation and standardization" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed technical regulation of the Republic of Belarus "Milk and dairy products. Safety" (TP 2010/018/BY) (further - the technical regulation) and to enact it since January 1, 2014.

2. The certificates of conformity and declarations of conformity issued (accepted) before entry into force of the technical regulation are effective during the terms established by the State committee on standardization, but no more expiration dates of milk and the dairy products which are in circulation on the date of entry into force of the technical regulation.

3. To provide to the state committee on standardization, the Ministry of Agriculture and Food, the Ministry of Health in case of development of the technical regulation of Eurasian economic community "Milk and Dairy Products" finishing line item of the Belarusian side to interested, in case of its acceptance to introduce in accordance with the established procedure in Council of Ministers of the Republic of Belarus the offer on reduction of this resolution in compliance with the specified regulations.

4. To the Ministry of Agriculture and Food together with interested to develop and approve the actions plan on enforcement of the technical regulation.

5. To the state committee on standardization together with the Ministry of Health to approve the list of the technical regulatory legal acts interconnected with the technical regulation and to provide its permanent updating.

6. To provide to republican state bodies till January 1, 2014 reduction of the technical regulatory legal acts in compliance with this resolution.

7. This resolution becomes effective from the date of its official publication.

Technical regulation of the Republic of Belarus "Milk and dairy products. Safety" (TP 2010/018/BY)

Article 1. Scope

1. This technical regulation extends to the milks and dairy products released in the Republic of Belarus, including:

1.1. raw milk;

1.2. milk conversion products, including:

raw skim milk and crude cream;

dairy products;

dairy compound products;

milk-containing products;

products of baby food on milk basis;

milk conversion by-products.

2. This technical regulation extends also to functionally necessary components used in case of production of products of conversion of milk.

3. This technical regulation establishes requirements to safety of milk and dairy products, processes of their production, storage, transportation, realization for the purpose of protection of life, health and heredity of the person, and also the prevention of the actions misleading consumers concerning purpose of milk and dairy products, their quality or safety.

4. This technical regulation does not extend on:

the milk and dairy products received in the course of nonindustrial production, including intended for home use;

the materials contacting to foodstuff, requirements to which safety are established by the corresponding technical regulation.

Article 2. Terms and determinations

In this technical regulation the following terms and their determinations are applied:

adapted milk mix - the products of baby food for children of early age made in liquid or powdery form from milk of farm animals, proteins of soy (except for the proteins received from the raw materials containing genetically engineered organisms), as close as possible on chemical composition and properties to women's milk and the lives meeting physiological needs of children of the first year;

ayran - the fermented milk product made in the way mixed (lactic and spirit) fermentations with use of fermenting microorganisms of thermophilic lactic streptococci, the Bulgarian lactic stick and yeast with the subsequent addition of salt, water or without their addition;

albumine - the milk conversion product made from whey and representing concentrate of serumal proteins of milk;

acidophilus milk - the fermented milk product made with use of fermenting microorganisms of acidophilic lactic stick, lactococci and the ferment prepared on kefiric fungi in equal ratios;

delactosed products - specialized products of baby food, content of lactose in which constitutes no more 0,1 of gram on one liter of product, ready to the use;

biological product (further - bioproduct) - the milk conversion product made with use of fermenting microorganisms and enriched by addition in the course of souring and (or) after it live pro-biotic microorganisms (probiotics) in monocultures or associations and (or) prebiotics. Heat treatment of ready-made product is not allowed;

varenets - the fermented milk product made by the souring of the milk which is previously sterilized or subjected to other heat treatment at temperature of 97 + the 2nd hail. With, with use of fermenting microorganisms of thermophilic lactic streptococci before achievement of the corresponding organoleptic characteristics;

secondary milk raw materials - milk conversion by-product, dairy product with partially lost identification signs or consumer properties (including the products withdrawn within their expiration dates, but conforming to the safety requirements imposed to food staples), held for use after conversion;

dietary products of conversion of milk - the specialized products of conversion of milk having certain physical and chemical properties and intended for clinical or preventive foods;

ferments - the nonpathogenic, not toxicogenic microorganisms and (or) associations of microorganisms, mainly lactic microorganisms which are specially picked up and used for production of products of milk conversion;

substitute of dairy product - the foodstuff made generally or completely from not milk components and used in the same purposes as dairy product;

cottage cheese - the dairy product made from cottage cheese grain with addition of cream and table salt. Addition of stabilizers of consistence, preservatives and heat treatment of ready-made product are not allowed;

the manufacturer - the legal entity, including the foreign legal entity or the individual entrepreneur performing on its own behalf production of milk and (or) dairy products for realization to the consumer;

yogurt - the fermented milk product with the increased content of the dry fat-free milk substances made with use of mix of fermenting microorganisms of thermophilic lactic streptococci and the Bulgarian lactic stick;

casein - the milk conversion product made from skim milk and representing the main fraction of proteins of milk;

porridges on milk basis - the products of baby food on milk basis for children of early age made of different grain, dairy products and (or) milk-containing products with introduction of not milk components or without their introduction;
