About restriction of monopolistic activities and development of the competition

CHAPTER I GENERAL PROVISIONS

ARTICLE 1. Sphere of anti-monopoly regulation

1. The law governs the relations between subjects of entrepreneurship and bodies of authority and management in the course of activities in the republican goods market (further - the market). The law is applied and when the actions made by subjects of entrepreneurship and bodies of authority and management, or the agreements signed by them outside the Republic of Moldova lead to restriction of the competition or other negative effects in the market.

2. The law is not applied to subjects of entrepreneurship and bodies of authority and management which economic activity according to the legislation belongs to monopoly of the state.

3. The relations connected with legal protection of inventions, industrial designs, trademarks and copyright and also with activities in the security market and intellectual activities, are regulated by other legal acts.

ARTICLE 2. The state body performing anti-monopoly regulation

1. Carrying out state policy on development of the competition and restriction of monopolistic activities is performed by the Ministry of Economics.

2. The main objectives of the Ministry of Economics in the field of anti-monopoly regulation are:

development of measures for forming of the market relations on the basis of development of entrepreneurship and the competition;
