The government of the Republic of Belarus, the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic, the Government of the Russian Federation and the Government of the Republic of Tajikistan which are hereinafter referred to as with the Parties
proceeding from provisions of the Agreement on the Customs union and the Common economic space of February 26, 1999,
recognizing need of introduction of the approved approaches to application of export customs duties for protection of economic interests of the State Parties of the Customs union,
agreed as follows:
The solution of each of the Parties concerning introduction and application of export customs duties in trade with the third countries (daleeresheniye) is accepted according to the national legal system after the notification on the made decision of Integration committee of the Republic of Belarus, the Republic of Kazakhstan, the Kyrgyz Republic, the Russian Federation and the Republic of Tajikistan (the Integration committee hereinafter is referred to as further).
The integration committee sends the draft decision provided by the Party to three-day time to other Parties.
The parties provide decision making from the date of receipt of the introduced draft of the decision in a month. In case of rejection of the similar decision by the Parties measures for protection of economic interests of the State Party of the Customs union which made offers on the specified question are taken.
The Parties send the conclusion to Integration committee.
In case of rejection of the decision specified in Article 2 this Protocols by one or several Parties the matter is submitted for consideration of the Commission on customs tariff and non-tariff regulation under Integration committee and in case of not achievement of unanimity - for consideration of Integration committee for acceptance of agreed decision.
