based on regulations of the Contract between the Russian Federation and Ukraine on economic cooperation for 1998 - 2007 of February 27, 1998 and the Agreement between the Government of the Russian Federation and the Cabinet of Ministers of Ukraine on guarantees of transit of the Russian natural gas on the territory of Ukraine of the December 22, 2000 which further is referred to as with the Agreement of December 22, 2000

proceeding from need of ensuring stable growth of economy of the Russian Federation and economy of Ukraine,

agreed as follows:

Article 1

Extend operation of the Agreement of December 22, 2000, except for the appendices N 1 and N 2 and Articles 2, 5 both 9, for 2002 and the next years till 2013 inclusive.

Article 2

The Russian side guarantees carrying out settlings of JSC Gazprom with the National Joint Stock Company Naftogaz of Ukraine for services in transit of the Russian natural gas in the territory of Ukraine supply of gas and/or in cash.

Amounts of transit of the Russian natural gas across the territory of Ukraine, and also the amount of payments in cash and/or gas supply rates in payment of transit will be specified on the basis of annual intergovernmental protocols for the corresponding year.

The Russian side guarantees the transit of the Central Asian natural gas for gas supply of consumers of Ukraine performed on contractual basis between business entities across the territory of the Russian Federation in the amounts determined on the basis of annual intergovernmental protocols for the corresponding year on the conditions similar to conditions of transit by the Ukrainian Side of the Russian natural gas to Western Europe.

JSC Gazprom and the National Joint Stock Company Naftogaz of Ukraine till November 1, 2001 will sign the long-term contract about transit of the Russian natural gas across the territory of Ukraine for 2002 - 2013.
