believing that legal state cooperation shall promote goal achievement of justice and return of persons serving sentence to normal life in society,

considering that it is necessary for achievement of these purposes that persons imprisoned for crime execution were given opportunity to serve sentence in the state of their nationality or the permanent residence,

considering need of providing respect of human rights concerning convicts,

agreed as follows:

Article 1 of Determination

For the purposes of this Agreement the following terms mean:

"punishment" - imprisonment according to the court verdict of person who committed crime;

"sentence" - the judgment in which punishment is determined;

"convict" - person who serves custodial sanction based on the sentence which took legal effect;

"The state of adjudgement" - the state in which the sentence was pronounced;

"The state of execution of sentence" - the state to which the convict can be transmitted or already transferred.

Article 2 General provisions

1. Contracting parties will be by mutual consent and according to provisions of this agreement to transfer each other the persons condemned to imprisonment in the territory of one Contracting Party and who are citizens of other Contracting Party to the state of their nationality for serving of the rest of punishment.

2. This Agreement is equally applied to persons, irrespective of their nationality, having the permanent residence in the territory of the State of execution of sentence.

Article 3 Request about transfer

1. Transfer of the convict for serving sentence can be performed at the request of the State of adjudgement or the State of execution of sentence.

2. The convict, his close relatives or the legal representative has the right to appeal to any of Contracting Parties about transfer.
