being guided by the fact that legal state cooperation shall promote interests of justice and return of persons serving sentence in normal life in society,

considering that it is necessary for achievement of these purposes that persons imprisoned for making of criminal offense were given opportunity to serve sentence in the country of their nationality,

considering need of complete respect of human rights,

agreed as follows:

Article 1

1. Contracting parties shall transfer on demand according to provisions of this agreement each other the persons condemned to imprisonment for crime in the territory of one Contracting Party and who are citizens of other Contracting Party to the state of their nationality for serving sentence.

2. This Agreement is equally applied to persons irrespective of their nationality having the permanent residence in the territory of Contracting Parties.

3. Convicts to imprisonment are understood as persons who serve custodial sanction based on the court verdict which took legal effect.

Article 2

1. Transfer of the convict for serving sentence can be performed according to the offer:

1) the Contracting Party which court pronounces sentence (further - the State of adjudgement);

2) the Contracting Party to which the condemned person can be transferred for serving sentence (further - the State of execution of sentence).

2. The convict, his close relatives or the legal representative has the right to appeal to any of Contracting Parties about transfer of the convict.

3. The state of removal notifies on contents of this agreement of each convict to which this Agreement can be applied.

4. Transfer takes place when the consent of both the State of adjudgement, and the State of execution of sentence is received.

Transfer of the convict according to the procedure, provided by this Agreement, is not made if:
