About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. - In the Law on fauna No. 439-XIII of April 27, 1995 (Official monitor of the Republic of Moldova, 1995, No. 62-63, of the Art. 688), with subsequent changes, to make the following changes and additions:

1. State Article 3 in the following edition:

"Article 3. Property on fauna

(1) the Fauna is property of the state. Ensuring protection and preserving fauna is obligation of the state.

(2) Resources of fauna can be used according to Section III provisions."

2. Add Article 7 with Item f) the following content:

"f) acceptance of necessary measures for maintenance of populations of types at the level conforming to ecological, scientific and cultural requirements taking into account at the same time economic and recreational conditions of the territory or creation of conditions for adaptation of populations of types to these conditions."

3. Add Article 11 with the Item f 1) of the following content:

"f 1) of creation of the new biotopes, protection existing or recoveries of the degraded biotopes;"

4. Add Article 16 with part (3) the following content:

"(3) For protection of the types included in the Red List the following measures are established:

a) creation of the objects and complexes entering into fund of the natural territories protected by the state is preferential on lands where the animals included in the Red List and on the ways of migration of such animal species are widespread;

b) prohibition of withdrawal of animals from the environment, except as specified, provided in part (3) Article 27;

c) prohibition to disturb animals in their native habitat, especially during reproduction, wintering and migration.".

5. Add Article 29 with part (3) the following content:

"(3) Holding actions for regulation of number of some animal species is performed by means of the methods directed to maintenance of number of populations of all animal species at the level conforming to national and international ecological and scientific requirements without derogation at the same time of value of economic, cultural and recreational factors of the territory.".
