About modification of some legal acts concerning arrest of the assets connected with financing of terrorism and concerning the financial transactions stopped according to the decision made based on resolutions of the UN Security Council, and determination of procedure for access to such assets

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of administrative legal proceedings of Ukraine:

The Section III to add 1) with Article 183-4 of the following content:

"Article 183-4. Features of production on cases on the appeal of the Security Service of Ukraine concerning seizure of the assets connected with financing of terrorism and concerning the financial transactions stopped according to the decision made based on resolutions of the UN Security Council, removal of arrest from such assets and provision of access to them

1. Production for rather seizure of the assets connected with financing of terrorism and concerning the financial transactions stopped according to the decision made based on resolutions of the UN Security Council, removals of arrest from such assets and provision of access to them is performed based on the administrative claim of the Chairman of the Security Service of Ukraine or his deputy.

2. Administrative claim is submitted to Trial Court on the cognizance established by this Code, in writing and shall contain:

1) name of administrative court;

2) name, postal address, and also number of the means of communication of the applicant;

3) the address bases with the claim, circumstances which are confirmed by proofs, and requirements of the applicant;

4) the list of documents and other materials which are applied;

5) the authorized signature of the subject of powers of authority which is sealed.

3. In case of violation of requirements of part two of this Article the court reports about it to the applicant and determines term for remedial action.

Failure to meet requirements of court in the time established by it involves return to the applicant of the claim and the documents attached to it.
