About modification of some legal acts of Ukraine concerning implementation of the principle of state registration of legal entities based on the model charter

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Economic code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2003, NN 18-22, of the Art. 144):

Article 56 to add 1) with parts four and heel of the following content:

"4. The subject of managing can be created and act on the basis of the model charter approved by the Cabinet of Ministers of Ukraine which after its acceptance by participants becomes the constituent document.

5. If the subject of managing is created and acts on the basis of the model charter in the decision on its creation which is signed by all founders, data on its name, the purpose and subject of economic activity, and also information on implementation of activities on the basis of the model charter are specified";

Part third of Article 62 to state 2) in such edition:

"3. The company if other is not established by the law, acts on the basis of the Charter or the model charter. The companies irrespective of pattern of ownership, legal form, and also constituent documents based on which they are created and are effective, have the equal rights and obligations";

3) in Article 74:

"acts on the basis of the Charter" part one after words to add with the words "or model charter";

in part four of the word "provided by the charter of the company" to exclude;

To exclude 4) in part three of Article 76 of the word "in the amount specified in the charter of the company";

Article 82 to add 5) with part ten of the following content:

"10. Economic society can be created and act on the basis of the model charter according to the procedure, determined by the law.
