About introduction of amendments to the Law of Ukraine "About notariate"
The Verkhovna Rada of Ukraine decides:
I. Bring in the Law of Ukraine "About notariate" (Sheets of the Verkhovna Rada of Ukraine, 1993, N 39, Art. 383; 2009, N 13, Art. 161) such changes:
1. State Article 10 in such edition:
"Article 10. The highest qualification commission of notariate and procedure for its work
For determination of level of professional readiness of persons who intend to be engaged in notarial activities and solutions of question of cancellation of the certificate on the right to occupation notarial activities under the Ministry of Justice of Ukraine form the Highest qualification commission of notariate. The staff of the Highest qualification commission of notariate affirms the order of the Ministry of Justice of Ukraine.
The term of office of staff of the Highest qualification commission of notariate constitutes three years, since day of its approval.
The regulations on the Highest qualification commission of notariate affirm the Cabinet of Ministers of Ukraine.
After passing of training of person which intend to pass qualification examination for the right to occupation notarial activities are allowed by the Highest qualification commission of notariate to its delivery based on representation according to Head department of justice of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea, head departments of justice in areas, the cities of Kiev and Sevastopol.
The procedure for the admission to passing qualification examinations and their carrying out is established by the Ministry of Justice of Ukraine.
Based on results of the passed examination the Highest qualification commission of notariate makes the decision on issue (or refusal in issue) the Ministry of Justice of Ukraine of the certificate on the right to occupation notarial activities.
