About introduction of amendments to some laws of Ukraine of rather mortgage bonds
The Verkhovna Rada of Ukraine decides:
I. Make changes to such laws of Ukraine:
1. Item 6 parts one of article 4 of the Law of Ukraine "About state regulation of the security market in Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 1996, N 51, Art. 292; 2006, N 31, 268) to state the Art. in such edition:
"6) activities for management mortgage the pokrytiyemdeyatelnost which is performed by the manager of mortgage covering on its own behalf for remuneration during certain term based on the agreement on management of mortgage covering and provides representation of interests of owners of mortgage bonds, control of observance of terms of replacement of mortgage assets or inclusion of new mortgage assets in structure of mortgage covering, control of timeliness and completeness of implementation by the issuer of payments according to regular mortgage bonds, ensuring compliance of mortgage covering to requirements of the legislation, accomplishment of other functions determined by the legislation".
2. Part the second article 5 of the Law of Ukraine "About recovery of solvency of the debtor or recognition by his bankrupt" (Sheets of the Verkhovna Rada of Ukraine, 1999, N 42-43, Art. 378; 2002, N 17, 117) to add the Art. with words "and about recognition of the issuer of mortgage bonds by insolvent (bankrupt) - in the part which is not contradicting the Law of Ukraine "About mortgage bonds".
3. Article 3 of the Law of Ukraine "About banks and banking activity" (Sheets of the Verkhovna Rada of Ukraine, 2001, N 56, Art. 30; 2007, N 2, 15) to add the Art. with part five of such content:
"Regulates the relations arising in case of application of the procedure of temporary administration and liquidation of the issuer of mortgage bonds, this Law in part which does not contradict the Law of Ukraine "About mortgage bonds".
