About some questions of preparation of cases for legal proceedings
Plenum of Supreme Economic Court of the Republic of Belarus, having considered materials of generalization of court practice of application of the economic procedural legislation by preparation of cases for legal proceedings, for the purpose of ensuring the correct and uniform application of the Economic Procedure Code of the Republic of Belarus by preparation of cases for legal proceedings, being guided by Articles 74, 75 Codes of the Republic of Belarus about judicial system and the status of judges, decides to make the following explanations.
1. Preparation of case for legal proceedings is the obligatory independent stage of economic process aiming at ensuring the correct and timely consideration by economic courts of cases.
Tasks of economic court by preparation of case for legal proceedings are determined by Article 168 of the Economic Procedure Code of the Republic of Belarus (further - HPK).
2. Preparation of case for legal proceedings begins with the moment of removal by economic court of determination about adoption of the action for declaration (the statement, the claim) and initiation of proceeedings and comes to the end with carrying out preparatory judicial session which shall take place no later than fifteen working days from the date of receipt of the statement in economic court, or in the terms established by part six of article 161 HPK if one of the parties of dispute is outside the Republic of Belarus.
