About damage liability, put as a result of defect in products

Article 1. Determination of terms

1. In this Law terms are used in such value:

1) introduction of products in the address - any first paid or free delivery of products for its distribution, consumption (use) in the market of Ukraine;

2) the producer - the producer of finished goods, raw materials or the component, products component, and any person who, placing the name, trademark or other sign on products, declares as about the producer;

3) the user - the physical person which acquires orders, uses products for implementation of business activity or fulfillment of duties of hired employee, or the legal entity who acquires uses products;

4) the victim - the consumer or the user to whom damage as a result of defect in products is caused;

5) products - any personal estate, including finished goods, raw materials and the component, including the property which is component of other personal or real estate. The term "products" includes also the electric power;

6) damage - the mutilations put as a result of defect in products, other damage of health or the death of person, damage or destruction of any object of the property right, except for products, faulty.

Article 2. Law coverage

1. This Law governs the relations concerning damage liability, put injured with defect in products introduced into circulation in Ukraine.

2. Provisions of the civil, procedural legislation and the consumer protection law are applied to the relations which are not settled by this Law.

3. The Nsstoyashchy Law does not limit any rights of the victim according to the contractual or not contractual commitments establishing other, than provided by this Law, responsibility, in particular the rights to compensation of moral damage or the right to compensation of damage in certain spheres of the civil relations according to the legislation.
