About modification of the Economic Procedure Code of Ukraine of rather procedural successorship

The Verkhovna Rada of Ukraine decides:

1. Bring in the Economic Procedure Code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 1992, N 6, the Art. 56) such changes:

Article 25 to state 1) in the following edition:

"Article 25. Procedural successorship

In case of death or the announcement of physical person the dead, the terminations of activities of the subject of housekeeping by reorganization (merge, accession, separation, transformation), replacements of the creditor or the debtor in the obligation, and also in other cases of replacement of person in the relations concerning which there was dispute the economic court involves in participation in the matter of the legal successor of the relevant party or the third party at any stage of legal procedure.

All actions made in legal procedure to the introduction to the legal successor are obligatory for it the same as they were obligatory for person whom the legal successor replaced.

About replacement or about refusal of replacement of the party or the third party by her legal successor the economic court passes the decision";

Item 3 parts one of Article 62 to state 2) in the following edition:

"3) there came the death of the physical person or it is announced by the dead or activities of the subject of managing which filed the action for declaration or to which the claim is made are stopped if disputable legal relationship do not allow successorship";

3) in Item 3 parts two of Article 79 of the word "as a result of reorganization of the company, the organization" to exclude;

Item 6 parts one of Article 80 to state 4) in the following edition:
