About modification of the Code of penal procedure of Ukraine concerning participation of jurymen

The Verkhovna Rada of Ukraine decides:

I. Make the following changes to the Code of penal procedure of Ukraine:

1. In Article 17:

Part the second to state 1) in such edition:

"Criminal cases about crimes for which the law prescribes custodial sanction for the term of more than ten years are considered in Trial Court jointly by court as a part of three persons if the defendant declared the petition for such consideration, and for crimes for which the law provides possibility of assignment of punishment in the form of lifelong imprisonment, - as a part of three persons irrespective of availability of the petition of the defendant for such consideration";

Part third to exclude 2).

2. In the text of Article 18 of the word "and jurymen" to exclude.

3. In Item 5 of Article 32 of the word "juryman" to exclude.

4. In Article 54 part one:

To exclude 2) in item 4 of the word "or juryman".

5. To state part one of Article 56 in such edition:

"In the presence of the circumstances provided by Articles 54 and 55 of this Code, the judge shall declare rejection. On the same bases removal of the judge can be declared by the prosecutor, the defendant, the defender, and also the victim and his representative, the civil claimant and the civil defendant or their representatives".

6. In Article 57:

To exclude 1) in part one of the word "or to the juryman";

Part the sixth to exclude 2).

7. Exclude Article 259.
