About approval of Rules of transportation of goods by railway transport

According to the subitem 9) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of December 8, 2001 "About rail transport" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of transportation of goods by railway transport.

2. This resolution becomes effective after ten calendar days after the first official publication.

Rules of transportation of goods by railway transport

1. General provisions

1. These rules of transportation of goods by railway transport (further - Rules) are developed according to the Law of the Republic of Kazakhstan of December 8, 2001 "About rail transport" (further - the Law) and determine procedure for the organization and condition of transportation of goods by railway transport in the Republic of Kazakhstan.

2. Transportation of goods by railway transport in the international and transit message through the Republic of Kazakhstan is performed according to the legislation of the Republic of Kazakhstan and international treaties ratified by the Republic of Kazakhstan.

3. Technical loading rates and fixtures of loads, procedure and conditions of transportations of liquid cargoes in bulk, dangerous goods, not provided by these rules, are established by international agreements (agreements) the accepted within the Organization of cooperation of the railroads and Council for rail transport of member countries of the Commonwealth of Independent States (CIS) and the Republic Latvia, the Republic Lithuania, the Republic of Estonia and other international agreements (agreements) which participant is the Republic of Kazakhstan.

4. In Rules the following concepts are used:

1) unplanned transportation - the transportation of goods which is not provided by the main plan for the request which arrived during current month;

2) single engineering procedure of work of siding and the station of adjunction (ETP) the technological act determining conditions of interaction of siding and the station of adjunction which is drafted for the siding of the organization serviced by own locomotive and having average daily cargo turnover of 50 and more cars;

3) the inventory car (container) - goods wagon (container) registered in the Automated database of data processing center of railway administrations behind railway administration of the CIS countries, Latvia, Lithuania and Estonia;

4) ring route - the train of the established weight and length consisting of the cars shipped by homogeneous load one consignor from one station of origin to one consignee appointment to one station and drawn up by one delivery note, in case of absolute return of empty cars from under unloading on initial station of origin;

5) route - the train of the established weight or length created by the consignor on siding or at the railway station;

6) the main plan of transportation - the request (plan) for transportation of goods for the forthcoming month accepted and approved by carrier;

7) adjusting task - task of the station for delivery of empty cars from under unloading and acceptance of empty cars under loading, and also providing qualitative indexes of use of railway vehicles and uniform distribution of cars (containers) on stations;

8) dual cargo operation - use by the consignee of the car unloaded by it, container for loading of load;

9) connecting way - railway track of special purpose which connects parks of stations or the station to sidings;

10) specialized containers - the containers having special design and intended for loads of separate types: loose, liquid, perishable, dangerous and other goods;

11) terms (technological time) of loading, unloading (unloading) - time spent for accomplishment of loading and unloading of loads mechanized or nonmechanized by methods taking into account costs of time for preparatory, auxillary and final operations on places public and sidings (further - technological time);

12) the plate of KBQ - the plate established by "The international convention on safe containers" (KBQ), attached without fail on door of universal container in case of production or capital repairs and certifying safety of its operation;

13) the customs plate (KTK) - the rectangular metal plate of certain size and content attached to container and confirming it suitability for transportation of goods under customs control;

14) transport packet - the enlarged cargo piece created from the certain places of load in container (boxes, sacks, barrels, specialized containers) or without container fastened among themselves by means of universal special one-time use or the multicurrent packing assets, on pallets or without them;

15) universal container - the unified unit load of the transport equipment of repeated application with unobstructed capacity for cargo placement providing safe cargo hauling with one or several modes of transport which is representing standardized on weight gross, to overall dimensions, design and marking, and having design for the mechanized loading, unloading (unloading) and overload, used for transportation of the wide nomenclature of load;
