Article 1. Bring in the Civil code of the Republic of Belarus of December 7, 1998 (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus, 1999, No. 7-9, of Art. 101; National register of legal acts of the Republic of Belarus, 2008, No. 157, 2/1444) following changes and amendments:
1. To state Items 3 and 4 of Article 331 in the following edition:
"3. Starting price of pledged property with which the biddings begin is determined by the judgment according to the procedural legislation in case of the address of claim to property judicially or the agreement of the pawnbroker and pledger in case of the address of collection on this property without appeal to the court if legal acts do not provide other.
The pledged property is on sale to person who offered the highest price at the biddings.
If the biddings, including repeated, are acknowledged cancelled owing to the fact that the application (statement) for participation in them is submitted only by one participant, in the cases provided by legal acts, the subject of the biddings is on sale to this participant in case of its consent at the initial price increased by five percent.
4. In case of the announcement of the biddings cancelled and refusal of the single participant who submitted the application (statement) for participation in the biddings of acquisition of pledged property at the initial price increased by five percent if the possibility of such acquisition is provided by legal acts the pawnbroker has the right to acquire pledged property under the agreement with the pledger and to offset the requirements provided with pledge on account of purchase price. Rules about the purchase and sale agreement are applied to such agreement.
