About introduction of amendments to articles 236 and 325 of the Code of penal procedure of the Russian Federation

Bring in the Code of penal procedure of the Russian Federation (The Russian Federation Code, 2001, N 52, Art. 4921; 2003, N 27, Art. 2706; 2009, N 44, Art. 5173; 2010, N 14, Art. 1552) following changes:

Part one of Article 236 to add 1) with Item 7 of the following content:

"7) about allocation or impossibility of allocation of criminal case in separate production in the case provided by part two of article 325 of this Code and about purpose of judicial session.";

Part the second Article 325 to state 2) in the following edition:

"2. Criminal case in which several defendants are involved is considered by court with participation of jury members concerning all defendants if at least one of them declares the petition for consideration of criminal case by court in this structure in the absence of objections from other defendants. If one or several defendants refuse court with participation of jury members, the court resolves issue of allocation of criminal case concerning these defendants in separate production. At the same time by court it shall be determined that allocation of criminal case in separate production will not interfere with comprehensiveness and objectivity of permission of the criminal case allocated in separate production and the criminal case considered by court with participation of jury members. In case of impossibility of allocation of criminal case in separate production criminal case in general is considered by court with participation of jury members.".
