Article 1

Bring in the Code of penal procedure of the Russian Federation (The Russian Federation Code, 2001, N 52, Art. 4921; 2003, N 27, Art. 2706; 2006, N 31, Art. 3452; 2007, N 24, Art. 2830; N 31, of Art. 4011; N 50, of Art. 6235; 2010, N 17, Art. 1985; N 27, of Art. 3427; N 30, of the Art. 4003) following changes:

Item 3 parts two of Article 82 to state 1) in the following edition:

"3) withdrawn from illicit trafficking in ethyl alcohol, alcoholic and alcohol-containing products, drugs, psychotropic substances, the plants containing drugs or psychotropic substances or their precursors or their parts containing drugs or psychotropic substances or their precursors and also objects which long-term storage is life-threatening also human health or for the environment, after carrying out necessary researches are given for their technological conversion or destroyed by a court decision according to the procedure, established by the Government of the Russian Federation about what the protocol according to requirements of article 166 of this Code is constituted. The sample, sufficient for comparative research, of the drug withdrawn from illicit trafficking, psychotropic substance, the plant containing drugs or psychotropic substances or their precursors or its parts containing drugs or psychotropic substances or their precursors joins the criminal case file;";

2) in Article 165:

a) in word part one "items 4 - 11 and 12" shall be replaced with words 9, "items 4 - 9, 10.1, 11 and 12";

b) add with part tretyey.1 the following content:

"3.1. By consideration of the petition for production of the investigative actions concerning realization or destruction of physical evidences, specified in Item 3 parts two of Article 82 of this Code the suspect, the person accused, their defenders and (or) legal representatives has the right to participate in judicial session also.".
