About modification and amendments in presidential decrees of the Republic of Belarus of August 30, 2002 No. 473 and of October 25, 2007 No. 534

For the purpose of further enhancement of procedure for traffic in weapons and ammunition to it in the territory of the Republic of Belarus, and also security activities in the Republic of Belarus:

1. Make changes and additions to the following presidential decrees of the Republic of Belarus:

1.1. in the Presidential decree of the Republic of Belarus of August 30, 2002 No. 473 "About measures for enhancement of regulation of turnover of military, office, civil weapon and ammunition to it in the territory of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2002, No. 100, 1/4006; 2006, No. 74, 1/7568; No. 186, 1/8061; 2007, No. 262, 1/9048; 2008, No. 5, 1/9287; No. 119, 1/9693; 2010, No. 199, 1/11874):

1.1.1. in Item 1:

state subitem 1.3 in the following edition:

"1.3. Procedure for leasing of the separate types and models of military weapon and ammunition to it transferred by law-enforcement bodies to legal entities with singular authorized problems *;";

state subitem 1.5 in the following edition:

"1.5. The list of separate types and models of military weapon and the ammunition to it leased by law-enforcement bodies to legal entities with singular authorized problems;";

add Item with subitem 1.8 of the following content:

"1.8. The list of legal entities with singular authorized problems.";

add Item 2 with paragraphs the fourth and fifth the following content:

"legal entities with singular authorized problems use weapon only for accomplishment of the singular authorized problems assigned to them by legal acts. Use of weapon by them for accomplishment of other tasks and functions is forbidden;

1.1.2. according to the procedure of turnover of military, office, civil weapon and ammunition to it in the state military forming and paramilitary organizations, customs authorities and bodies of prosecutor's office, approved by this Decree:

"5. The state military forming and paramilitary organizations, customs authorities and bodies of prosecutor's office have the right:

5.1. voluntary conveyance of weapon and ammunition to it in operational management of other state military forming and paramilitary organizations, customs authorities and bodies of prosecutor's office;

5.2. paid alienation of the weapon and ammunition to it including which is not connected with the termination of the right of republican property without holding auctions or tenders based on the purchase and sale agreements signed according to the civil legislation;

5.3. leasing or transfers to free use of weapon and ammunition to it;

5.4. sales of office and civil weapon, ammunition to it in the presence of the certificate of conformity issued in National system of confirmation of conformity of the Republic of Belarus, to the legal entities having the license for sales right of weapon and ammunition;

5.5. acquisitions of weapon at the legal entities having the right to production and realization of weapon, the citizens of the Republic of Belarus, foreign citizens and persons without citizenship who are constantly living in the Republic of Belarus.";

in part two of Item 12 of the word "collecting or exhibiting" shall be replaced with words "the right of collecting or exhibiting";

in subitem 28.1 of Item 28 of the word "and also trade in it" to replace with the word "realization";

1.1.3. according to the procedure of turnover of office and civil weapon and ammunition to it in the territory of the Republic of Belarus, approved by this Decree:

"Traffic in weapons and the ammunition to it consisting on arms of legal entities with singular authorized problems is regulated by this Procedure taking into account features, stipulated in Item 3, parts one, third or heel of Item 4, Items 6-27, 29-32 of the Procedure for traffic in weapons and the ammunition to it consisting on arms of the militarized protection, No. 534 approved by the Presidential decree of the Republic of Belarus of October 25, 2007 "About measures for enhancement of security activities" (The national register of legal acts of the Republic of Belarus, 2007, No. 262, 1/9048).";

in Item 12: in subitem 12.1 of the word "collecting or exhibiting" shall be replaced with words "the right of collecting or exhibiting";

in subitem 12.2 of the word "its collecting or exhibiting" shall be replaced with words "the right of its collecting or exhibiting";

in subitem 13.3 of Item 13 of the word "in temporary use" shall be replaced with words "in lease (free use)"; in part three of Item 19 of the word "in temporary use" shall be replaced with words "in lease";

in subitem 27.2 of Item 27 of the word "its collecting or exhibiting" shall be replaced with words "the right of its collecting or exhibiting";

in parts two and third Item 29 the word "collecting" shall be replaced with words "the collecting right";

in Item 40 and paragraph one of Item 42 of the word "on exhibiting" shall be replaced with words "on the exhibiting right";

in part two of Item 43 of the word "arms trade and ammunition, and also them" shall be replaced with words "realization of weapon and ammunition, including";

in part one of Item 72 of the word "their collecting or exhibiting" shall be replaced with words "the right of their collecting or exhibiting";

in Item 76 of the word "issued to legal entities and citizens in temporary use" shall be replaced with words "leased to legal entities or issued to citizens in free use";

1.1.4. according to the procedure of obtaining by legal entities with singular authorized problems in temporary use of separate types and models of military weapon and ammunition to it, approved by this Decree:

to state the name of the Procedure in the following edition:

"Procedure for leasing of the separate types and models of military weapon and ammunition to it transferred by law-enforcement bodies to legal entities with singular authorized problems";

state Item 1 in the following edition:

"1. This Procedure governs the relations arising in case of the leasing of separate types and models of military weapon and ammunition to it (further, unless otherwise specified, – military weapon) transferred by law-enforcement bodies to legal entities with singular authorized problems (further, unless otherwise specified, – the organizations) according to the list approved by the President of the Republic of Belarus.";

in Item 2 of the word "it is issued to the organizations in temporary use" shall be replaced with words "it is leased to the organizations";
