The governments of the State Parties of this agreement which are hereinafter referred to as - Contracting Parties,

being guided by provisions of the Convention on international civil aviation of 1944 (further - the Chicago convention) and attaching significance to civil aviation as one of important factors of cooperation of the people of the State Parties of the Commonwealth of Independent States,

considering reached at the 23rd session of Assembly of International Civil Aviation Organization (Montreal, on October 6, 1980) consent on need of transfer of certain functions and obligations by the state of registration to the state - to the operator of the aircraft in case of lease, chartering of aircrafts and exchange of them or any similar actions concerning such aircrafts,

aiming to provide in the greatest possible degree of action, promoting safe development of civil aviation,

agreed as follows:

Article 1

Contracting parties when implementing flights within airspace over the territories of their states temporarily, before ratification of article 83 bis of the Chicago convention, recognize need to apply provisions of this article which states:

"a) Despite provisions of Articles 12, 30, 31 and 32a), in that case when the aircraft registered in the Contracting state is operated according to the lease agreement, chartering or mutual exchange of aircrafts or according to any similar agreement the operator whose main place of activities or if it does not take such place of activities which permanent residence is in other Contracting state, the state of registration can transfer under the agreement with such other state to it everything or part of the functions and obligations as the states of registration concerning this aircraft, provided by Articles 12, 30 31 and 32a). The state of registration is exempted from liability concerning the transferred functions and obligations.
