wishing to provide protection of national production, creation of the conditions promoting development of the competition between national and foreign producers, and also increase in competitiveness of national products

being guided by provisions of the Agreement on application of special protective, anti-dumping and countervailing measures in relation to the third countries of January 25, 2008, Agreements on establishment and application in the Customs union of procedure for transfer and distribution of import customs duties (other duties, taxes and fees having equivalent action) of May 20, 2010 and other documents creating the contractual legal base of the Customs union and also the commonly accepted regulations and the principles of international law,

agreed as follows:

Article 1

The special protective, anti-dumping and countervailing measures applied according to the legislation of state members of the Customs union concerning commodity import from the third countries in the territory of state members of the Customs union are subject to revision regarding establishment of share of production of national producers similar (for the purposes of anti-dumping and compensation investigations) or the similar or directly competing goods (for the purposes of special protective investigation) for which the damage or threat of damage, in the total production of state members of the Customs union was established.
