About modification of some legal acts of Ukraine concerning the road accidents and payment of insurance indemnity

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Verkhovna Rada of USSR, 1984, appendix to No. 51, the Art. 1122):

Article 124 to add 1) with the note of the following content:

"Note. Person whose civil responsibility is insured is exempted from the administrative responsibility for road traffic offense which entailed damage of vehicles provided that participants of the road accident used the right jointly to constitute the notification on this incident according to the Law of Ukraine "About compulsory insurance of civil responsibility of owners of land vehicles";

Item of 1 part one of Article 255 to add 2) with the paragraph of the following content:

"to body of technical supervision of the Ministry of agrarian policy of Ukraine (Article 188-27)";

Paragraph two of part two of Article 308 to add 3) with the words "and specified in the resolution on recovery of penalty".

2. In the Law of Ukraine "About compulsory insurance of civil responsibility of owners of land vehicles" (Sheets of the Verkhovna Rada of Ukraine, 2005, No. 1, Art. 1; 2006, No. 1, Art. 3; 2009, No. 10-11, of Art. 137; with the changes made by the Law of Ukraine of December 2, 2010 No. 2756-VI):

1) in Article 1:

a) state Items 1.3 and 1.4 in the following edition:

"1.3. the victims - legal entities and physical persons, lives, to health, and/or property of which harm as a result of the road accident with use of the vehicle is done;

1.4. persons whose responsibility is insured, - the insurer and other persons operating the secure vehicle on legal causes";

b) add Item 1.5 with the paragraph the second the following content:

"In this Law the device falling under the signs noted in this Item, but concerning which the adjusting factor depending on vehicle type is not established is not considered the vehicle";
