About introduction of amendments to the Resolution of the Cabinet of Ministers of Ukraine of October 7, 2003 No. 1585

1. Bring in the resolution of the Cabinet of Ministers of Ukraine of October 7, 2003 No. 1585 "About approval of the Technical regulation of modules of assessment of conformity and requirements concerning marking by national mark of conformity which are applied in technical regulations" (The Official Bulletin of Ukraine, 2003, No. 41, by Art. 2175; 2007, No. 1, the Art. 31) changes which are applied.

2. To the central executive bodies to which functions of technical regulation in certain fields of activity and developments of technical regulations are assigned to make in accordance with the established procedure offers concerning reduction of acts of the Cabinet of Ministers of Ukraine in compliance with this resolution.

Changes which are made to the resolution of the Cabinet of Ministers of Ukraine of October 7, 2003 No. 1585

1. In the name and the deciding part of the resolution of the word "and requirements concerning marking by national mark of conformity which are applied in technical regulations" to exclude.

2. The technical regulation of modules of assessment of conformity and requirements concerning marking by national mark of conformity which are applied in technical regulations, approved by the specified resolution to state in the following edition:

"No. 1585 is approved by the Resolution of the Cabinet of Ministers of Ukraine of October 7, 2003

(in edition of the Resolution of the Cabinet of Ministers of Ukraine of August 31, 2011 No. 920)

Technical regulation of modules of assessment of conformity

General part

1. This Technical regulation establishes the main requirements to carrying out assessment procedure of compliance and determines modules of its carrying out.

2. In this Technical regulation terms are used in the value given in the Laws of Ukraine "About standardization", "About confirmation of conformity", "About standards, technical regulations and assessment procedures of compliance" and "About consumer protection".

3. Modules - complexes of the unified assessment procedures of compliance (further - the module) which are chosen according to requirements of Item 5 of this Technical regulation are used to carrying out the assessment procedure of compliance provided by the corresponding technical regulation.

4. When it is provided in case by the corresponding technical regulation, assessment procedure of compliance can be carried out with variation from some requirements established by this Technical regulation, in particular relatively:

provisions of the additional information in technical documentation;

storage duration of technical documentation;

instructions:

- the choice of the producer concerning carrying out testing of the producer by akcreditirovanny test laboratory or the appointed conformity assessment body of products (further - the appointed body), the elected producer;

- method of conducting check of products by testing of each product sample or by testing using method of random sampling;

- effective period of the certificate of check of type;

provisions in the certificate of check like the important information concerning assessment of conformity and control without stopping of production and which is subject to inclusion in the certificate or its appendices;

the provisions concerning obligations of the appointed body to inform the executive body which appointed it on frequency of conducting checks by the appointed body.

For products made to order or small batch, more flexible conditions concerning assessment procedures of compliance are applied.

5. Modules are used taking into account the following principles:

non-admissions of issuance of products which do not meet, in particular, safety requirements for life and health of the person, property, and also protection of the surrounding environment;

use of modules depending on blueprint stages and production;

evaluating compliance of products on blueprint stages and productions before its introduction in the address;

enough modules for ensuring compliance of products to the established requirements, the choice of modules taking into account products type, availability or absence of the third party, conditions of production;

inadmissibility of use of too difficult modules, considering the purpose of ensuring compliance of products to the requirements established by the technical regulation;

the producer shall have possibility of the choice between modules of quality assurance and modules of certification of products (except cases when the specific procedure is applied to ensuring compliance to the requirements established by technical regulations).

6. For assessment to compliance modules A, A 1, A 2, by B, C, C1, C2, D, D1, E, E1, F, F 1, G, H, H1 are used.

7. The module B is used for carrying out part of assessment procedure of compliance of check of type and used on blueprint stage. The specified module is used together with C, C 1, modules C 2, D, E, F, than assessment of conformity on production stage is provided.
