The Customs Services of the State Parties of the CIS which are hereinafter referred to as by the Parties, interested in practical implementation of the Concept of cooperation of Customs Services of the State Parties of the Commonwealth in the field of hardware approved by the decision of Council of heads of Customs Services of the State Parties of the Commonwealth No. 3/23 in Kiev on May 14, 1999, recognizing need of combination of their efforts on maintaining confidentiality of information in the field of hardware, agreed as follows:

Article 1

The terms used in this agreement have the following value:

"confidential information" - documentary information in the field of hardware, access to which is limited according to national legal systems of the State Parties of the CIS in connection with its value and uncertainty to the third parties;

"maintaining confidentiality of information" - the activities directed to prevention of information leakage about hardware of customs authorities;

"technical means" - means of informatization, the means of communication, technical means of customs control and special technical means.

Article 2

The parties perform cooperation in the field of maintaining confidentiality of information which leakage can cause damage to interests of the Parties and their states. This agreement does not raise the questions of protection of the data which are the state secret, determined by national legal systems of the State Parties of the CIS.

Article 3

Each Party according to the national legal system of its state and this agreement takes measures for the purpose of ensuring confidentiality of information transferred to it by other Party.

The parties not transfer confidential information without written consent the Parties from which it is received to any third party, including its legal entities and physical person.
