About introduction of amendments to articles 809 and 810 of part two of the Civil code of the Russian Federation

Article 1

Bring in part the second the Civil code of the Russian Federation (The Russian Federation Code, 1996, N 5, the Art. 410) the following changes:

Article 809 to add 1) with item 4 of the following content:

"4. In case of the return ahead of schedule loan amounts provided under percent according to Item 2 of article 810 of this Code, the creditor has the right from the borrower of the percent on the loan agreement added inclusive about day of return of loan amount completely or its parts.";

2) in Item 2 of Article 810:

a) state paragraph two in the following edition:

"The loan amount, provided under percent to the borrower citizen for the personal, family, home or other use which is not connected with business activity can be returned by the borrower citizen ahead of schedule completely or in parts on condition of the notification on it of the creditor at least in thirty days prior to day of such return. By the loan agreement shorter time for notification of the creditor about intention of the borrower to return money ahead of schedule can be established.";

b) add with the paragraph of the following content:

"The loan amount, provided under percent in other cases, can be returned ahead of schedule with the consent of the lessor.".

Article 2

Action of provisions of item 4 of Article 809 and Item 2 of Article 810 parts two of the Civil code of the Russian Federation (in edition of this Federal Law) extends to the relations which arose from loan agreements of credit agreements signed about day of entry into force of this Federal Law.
