About rules of import licensing by the State Parties of the Agreement on creation of the free trade area

The governments of the State Parties of the Commonwealth of Independent States which are referred to as further with the Parties

for the purpose of accomplishment of the agreement obligations about creation of the free trade area of April 15, 1994 and to the Protocol of April 2, 1999 on modification and amendments in the Agreement on creation of the free trade area of April 15, 1994 regarding providing free trade regime on customs area of the states of the Parties,

aiming at rapprochement of the national legal system of the states of the Parties for effective functioning of the free trade area,

recognizing that inadequate use of the procedure of import licensing of goods can constrain development of mutual trade,

agreed as follows:

Article 1 Coverage

The rules of import licensing determined by the this Protocol regulate the relations of the Parties arising in connection with commodity import, one of the Parties and other Parties intended for customs areas occurring from customs area.

The customs area of the states of the Parties is determined according to their national legal system.

Article 2 General provisions

1. For the purposes of the this Protocol import licensing of goods is determined as the administrative measure of regulation of foreign trade activity providing issue of the Party of the import license of certain types of goods by authorized state body based on the statement and/or other documents necessary for execution of the license.

2. Each of the Parties publishes in national official publications and reports Executive committee of the Commonwealth of Independent States of the rule of import licensing, and also information on the changes made to them and additions.

The official publication is performed in the terms determined by the national legal system and the international obligations of the state of each Party.
