About modification of some legal acts of Ukraine concerning settlement of the relations between creditors and consumers of financial services

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In article 109 of the Housing code of Ukraine (The sheet of the Supreme Council of USSR, 1983, appendix to No. 28, the Art. 573):

1) the second offer of part two to state in such edition: "The permanent premises which are provided to person from who evict shall be specified in the judgment";

2) the second offer of part three to state in such edition: "After adoption by the creditor of the decision on the address of collection on transferred to mortgage the apartment house or premises by extrajudicial settlement based on the agreement all residents shall according to the written requirement of the mortgage holder or to the new owner voluntarily to exempt the apartment house or premises within one month from the date of receipt of this requirement if the parties do not approve bigger term".

2. In the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):

"The citizen entrepreneur or the citizen - the founder (participant) or the official of business entity" to exclude 1) in part one of Article 222 of the word;

The name and paragraph one of part one of Article 388 to state 2) in such edition:

"Article 388. Illegal actions concerning property which it is seized, the forced property or the property described or which is subject to confiscation

1. Waste, alienation, concealment, substitution, damage, destruction of property or other illegal actions with property which it is seized, with the forced property or with the described property, or violation of restriction (burdening) of the right to use such property, performed by person to whom this property is entrusted, and also implementation by the bank representative or other financial institution of banking activities with means which it is seized".
