About modification of the Code of civil procedure of Ukraine concerning taking measures of providing the claim in case of recognition and execution of the foreign judgment

The Verkhovna Rada of Ukraine decides:

1. Bring in the Code of civil procedure of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2004, Art. N№40-42, 492) such changes:

Part one of Article 394 to add 1) with the paragraph the fifth such content:

"The court according to the statement of person which submits the petition for provision of permission to forced execution of the foreign judgment can take the measures of providing the claim provided by this Code. Providing the claim is allowed at any stage of consideration of such petition if non-use of measures of providing the claim can complicate or make impossible judgment accomplishment";

Article 395 to add 2) with part nine of such content:

"9. Consideration of question of acceptance of the measures of providing the claim provided by this Code is performed according to Articles 151-155 of this Code".

2. This Law becomes effective from the date of, its publication following behind day.
