About provision to the Promagroleasing open joint stock company which performed import in 2005 to customs area of the Republic of Belarus of agricultural machinery and spare part cases to it, privileges on payment of customs duties and the value added tax
For the purpose of cost reduction on production of agricultural products I decide:
1. Exempt Promagroleasing open joint stock company from:
1.1. payments of customs duties and the value added tax for the Republic of Belarus imported in 2005 on customs area according to contracts of February 15, 2005 No. 03-02-05 with "Franz Klein Fertribe Enzhiniring Gmbh" (Germany) and of July 15, 2005 No. 176/07/08-2004 with firm "Shtotts Agro-Service Gmbh and To. KG" (Germany) agricultural machinery and spare part cases to it for the total amount of 30 132 046 euros for transfer on the terms of finance lease (leasing) or to gratuitously legal entities of the Minsk region and Minsk according to appendix performing activities for production of agricultural products for the purpose of use in agricultural production;
1.2. the value added tax from turnovers on transfer on the terms of finance lease (leasing) to legal entities of the Minsk region and Minsk of agricultural machinery and the spare part cases to it specified in appendix to this Decree. Direct to the called legal entities the amounts released as a result of the provided privilege to replenishment of own current assets.
2. Determine that provision condition to Promagroleasing open joint stock company of privileges according to Item 1 of this Decree is reduction by this joint-stock company of the price of the agricultural machinery and spare part cases given under contracts to it for 15 percent.
In case of failure to carry out by this joint-stock company of the specified condition customs duties and the value added tax are collected according to the legislation.
