About modification and amendments in the Code of penal procedure of the Kyrgyz Republic

(1) the Measure of restraint in the form of detention, house arrest in case of investigation of criminal case is chosen by a court decision for a period of up to two months.
(2) in case of impossibility to complete the investigation till two months and in the absence of the bases for change or cancellation of measure of restraint this term can be extended by the judge of district (city) court or military court of garrison:
1) up to six months - according to the petition of the investigator approved with the supervising prosecutor;
2) up to nine months - according to the petition of the investigator approved with deputy attorneys general of the Kyrgyz Republic;
3) up to one year - according to the petition of the investigator approved with the Attorney-General of the Kyrgyz Republic.
(3) Further prolongation of term is not allowed. The person accused who is held in custody is subject to immediate release. Concerning exempted other measure of restraint is chosen.
