About modification of separate legal acts of the Russian Federation in connection with adoption of the Federal Law "About Procedure for Financing of Payments at the expense of Means of Pension Accruals"

Article 1

Bring in the Federal Law of April 1, 1996 No. 27-FZ "About the individual (personified) accounting in system of mandatory pension insurance" (The Russian Federation Code, 1996, No. 14, Art. 1401; 2001, No. 44, Art. 4149; 2003, No. 1, Art. 13; 2005, No. 19, Art. 1755; 2008, No. 18, Art. 1942; 2009, No. 30, Art. 3739; No. 52, Art. 6454; 2010, No. 31, Art. 4196; No. 49, Art. 6409; 2011, No. 29, Art. 4291; No. 45, Art. 6335) following changes:

In paragraph ten of Article 1 of the word "including the income" shall be replaced with words 1) "about the income";

In paragraph four of Article 3 of the word "and also for purpose of work pensions on the basis of insurance years of service of insured persons and their insurance premiums" shall be replaced with words 2) "for purpose of work pensions on the basis of insurance years of service of insured persons and their insurance premiums, and also for assessment of obligations to insured persons on payment of work pensions, due retirement benefit";

3) in Item 3 of Article 6:

a) add subitem 1.1 with words ", and also the income from their investment";

b) add subitem 1.2 with words ", and also the income from their investment";

c) state subitem 10 in the following edition:

d) in subitem 12 of the word "including the income" shall be replaced with words "and also about the income";

e) add with the subitem 14 of the following content:

"14) data on transfer of means of pension accruals to structure of means of payable reserve of the Pension Fund of the Russian Federation.";

4) in Article 16 part two:

a) in paragraph nine of the word "including the income" shall be replaced with words "and also about the income", to add with words ", data on payments at the expense of means of pension accruals";

b) add with the paragraph of the following content:

"provide to non-state pension funds on their requests information necessary for purpose of funded portion of work pension, and also other payments at the expense of means of pension accruals. Bring in the Federal Law of May 7, 1998 No. 75-FZ "About non-state pension funds" (The Russian Federation Code, 1998, No. 19, Art. 2071; 2001, No. 7, Art. 623; 2003, No. 2, Art. 166; 2004, No. 49, Art. 4854; 2005, No. 19, Art. 1755; 2006, No. 43, Art. 4412; 2007, No. 50, Art. 6247; 2008, No. 18, Art. 1942; No. 30, Art. 3616; 2009, No. 29, Art. 3619; No. 52, Art. 6450, 6454; 2010, No. 17, Art. 1988; No. 31, Art. 4196; 2011, No. 29, Art. 4291) following changes:

1) paragraph two of Item 2 of Article 2 to add with words ", implementation of due retirement benefits and lump retirement benefits to insured persons, implementation of payments to legal successors of insured persons";

2) in Article 3:

a) in paragraph three of the word "or payments to his legal successors" shall be replaced with words "and (or) due retirement benefit or lump sum payment or to perform payments to legal successors of insured person";

b) the nineteenth to state the paragraph in the following edition:

c) add with paragraphs of the following content:

"payable reserve - the isolated part of means of pension accruals created according to this Federal Law for implementation of payment of accumulated portion of work old-age pension;

safety of pension accruals - the requirement according to which the amount of means of pension accruals on the retirement account of funded portion of work pension of insured person for date of purpose of accumulated portion of work old-age pension and (or) due retirement benefit or lump sum payment shall not be less amount of insurance premiums for accumulated portion of work old-age pension, means of additional insurance premiums for funded portion of work pension, fees of the employer, fees on joint financing of forming of pension accruals, the funds (part of the means) of the maternity (family) capital allocated for funded portion of work pension, which arrived and considered on the retirement account of funded portion of work pension for the entire period of forming of pension accruals;

due retirement benefit - the monthly money payment established according to the procedure and conditions determined by this Federal Law and the Federal Law "About Procedure for Financing of Payments at the expense of Means of Pension Accruals";
