1. Make the following changes and additions to Methodical instructions for regulation of the amount of payment for the supplying and sales services rendered to final consumers by suppliers of gas, approved by the order of Federal Tariff Service of December 15, 2009 N 412-e/8 (it is registered by the Ministry of Justice of the Russian Federation on January 29, 2010, registration N 16159) (further - Methodical instructions):

a) state Item 9 in the following edition:

"9. When carrying out calculation of the amount of payment for supplying and sales services the reasonable unplanned loss of last years (unplanned profit, except the cases specified in Item of 8 presents of Methodical instructions) received by the organization performing regulated type of activity from regulated type of activity is considered. At the same time for the purpose of ensuring medium-term balance of dynamics of change of the amount of payment for supplying and sales services the covering of unplanned loss of last years (accounting of unplanned profit) within several years is possible.";

b) add with Item 9.1 of the following content:

"9.1. Expenses on payment of commission fees for services in acceptance of payments of the population for gas are not considered in expense structure of the organization performing regulated type of activity if their exception does not lead to increase in general level of payment of the population for gas including payment of the specified commission fees. At the same time the specified expenses are not considered in case of determination of the amount of payment for supplying and sales services only for cases in which the specified condition is satisfied.

In case of exception of the specified expenses at the rate of payment for supplying and sales services in a target way the settlement size of rate on the population group decreases. Data on exception of these expenses at the rate of payment for supplying and sales services are reflected in the order of Federal Tariff Service on approval of payment for supplying and sales services.";

c) exclude Item 11;

d) in Item 12:

- in paragraph six of the word "not for carrying out repairs, emergency works, implementation of transfer of gas pipelines" shall be replaced with words "not for carrying out repairs, emergency works, balancing and commissioning, implementation of transfer of gas pipelines, inserts, purges and fillings of again constructed new gas pipelines and other similar works which are not assuming systematic carrying out";

e) add Item 12 with the paragraph of the following content:

"If through one point of connection of networks of final consumers to gas and gas transmission distribution networks gas is delivered to one final consumer at the same time on the gas-using equipment put in the considered year into operation and on the gas-using equipment operated at least complete calendar year, then for the purpose of reference of such final consumer to groups on which the amount of payment for supplying and sales services of the supplier is differentiated, the total scope of supply of gas determined based on the methods which are stated above in this Item is used.";

e) in paragraph eight of Item 12 of the word "in Item 25" shall be replaced with words "in Item 20";

g) Items 12 - 14 to consider respectively Items 11 - 13;
