About introduction of amendments to the Law of Ukraine "About agreements on distribution of products" concerning enhancement of the mechanism of the conclusion of agreements on distribution of products

The Verkhovna Rada of Ukraine decides:

I. Bring in the Law of Ukraine "About agreements on distribution of products" (Sheets of the Verkhovna Rada of Ukraine, 1999, No. 44, Art. 391; 2011, No. 6, Art. 47; with the changes made by the Law of Ukraine of June 17, 2011 No. 3553-VI) such changes:

Article 1 after paragraph one to add 1) with the new paragraph of such content:

"the investor - the citizen of Ukraine, the foreigner, the stateless person, the legal entity of Ukraine or other state, the consolidation of legal entities created in Ukraine or outside Ukraine which has the corresponding finansovoekonomichesky and technical capabilities or the corresponding qualification for use of natural resources also is determined by the winner of tender; person determined by the paragraph the fifteenth parts one of article 7 of this Law in case of agreement signature with participation of such person; person who acquired the rights and obligations determined by the agreement on distribution of products as a result of assignment of rights and obligations according to article 26 of this Law".

With respect thereto to consider paragraphs of the second or eighth respectively paragraphs tretyimdevyaty;

3) in Article 6:

in part four:

the paragraph one to state in such edition:

"4. The agreement on distribution of products is signed with the winner of tender taking into account conditions of tender and the bid of the winner, and in the cases provided by the paragraph the fifteenth parts one of article 7 of this Law - with the winner of tender and person determined by the paragraph the fifteenth parts one of article 7 of this Law";

in the paragraph the second to replace the word "investor" with the word "participant";

in the paragraph the second to replace parts five of the word "investor" and "license" respectively with the words "subsoil user" and "special permission";
