About modification and amendments in the Code of penal procedure of the Republic of Belarus concerning cassation production

Article 1. Bring in the Code of penal procedure of the Republic of Belarus of July 16, 1999 (The national register of legal acts of the Republic of Belarus, 2000, No. 77-78, 2/71; No. 47, 2/152; 2003, No. 8, 2/922; 2010, No. 120, 2/1674) following changes and amendments:
1. In Item 17 of part 2 of Article 43 of the word "according to the judicial discretion" shall be replaced with words "in the cases provided by this Code".
2. Regarding 1 Article 370 of the word "or his representative" shall be replaced with words ", the private prosecutor or their representatives".
3. To state part 3 of Article 373 in the following edition:
"3. The person accused at its request is handed the copy of the claim or protest. If the writ of appeal of the victim, private prosecutor, their representatives, the prosecutor's appeal of the prosecutor contains request for cancellation or change of sentence on the bases able to entail deterioration of the situation of the person accused, their copies are handed to the person accused, and the copy of protest as well to the victim irrespective of its request.".
4. In Article 374:
regarding 1 word "concerning the person accused containing" shall be replaced with words "the person accused containing";
part 2 after the word "victim" to add with words ", private prosecutor".
5. In Article 380:
regarding 1 word "one month" shall be replaced with words "two months";
add Article with part 11 of the following content:
"11. The parties at least in five days prior to consideration of criminal case shall be informed by court of cassation instance on the place and time of its consideration.".
6. State Article 382 in the following edition:
"Article 382. Persons participating in consideration of criminal case in cassation procedure
