About the single tax for legal entities

The State Tax Service of Ukraine, in connection with adoption of law of Ukraine of 04.11.2011 No. 4014-VI "About introduction of amendments to the Tax Code of Ukraine and some other legal acts of Ukraine concerning simplified taxation system, accounting and the reporting" (further - the Law No. 4014-VI), become effective since January 1, 2012, reports the following.

According to Item 3 of the Section II "Final and transitional provisions" of the Law of Ukraine No. 4014-VI it is terminated the Presidential decree of Ukraine of July 3, 1998 No. 727/98 "About simplified taxation system, accounting and the reporting of small business entities".

According to Item 291.3 of article 291 of the Tax Code of Ukraine (further - NKU) the legal entity can independently choose simplified taxation system if such person meets the requirements established by Chapter 1 of the Section XIV NKU and is registered the payer of the single tax according to the procedure, determined by this Chapter.

As stipulated in Item 291.4 articles 291 NKU, concern to the fourth group of payers of the single tax legal entities - subjects of managing of any form of business who within calendar year correspond to set of such criteria:

the sredneuchetny number of workers does not exceed 50 people;

the amount of the income does not exceed 5 million hryvnias.

Definition of sredneuchetny number of workers is given by subitem 14.1.227 of Item 14.1 of article 14 NKU.

The procedure for determination of the income and their structure are stipulated in Clause 292 NKU.
