About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. - In the Criminal code of the Republic of Moldova No. 985-XV of April 18, 2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, No. 7274, of the Art. 195), with subsequent changes to make the following changes and additions:

1. In Article 123:

to state the name of Article in the following edition:

"Article 123. The official, the public figure and person who is taking up responsible state position";

part (to state 2) in the following edition:

"(2) As the public figure it is understood: the government employee including having special status (the employee of diplomatic service, Customs Service, bodies of defense, homeland security and protection of public order, other person having special or military rank); employee of autonomous or regulating authority of the public power, state or municipal company, other legal entity of the public law; the worker of office of persons who are taking up responsible state positions; person, authorized or authorized by the state to render public services from his name or to perform activities in public concerns.";

add Article with part (3) the following content:

"(3) As person who is taking up responsible state position it is understood: person, procedure for appointment or election of which is regulated by the Constitution of the Republic of Moldova either appointment or election of which according to the law is performed by Parliament, the President of the Republic of Moldova or the Government; adviser of local council; deputy of People's Assembly of Gagauzia; person to whom person who is taking up responsible state position delegated the powers.".

2. Add the code with Article of 1231 following contents:

"Article 1231. Foreign public figure and international employee
