Rules of transportation of passengers, baggage and loads on air transport

1. Basic concepts

1. These rules of transportation of passengers, baggage and loads on air transport (further - Rules) are developed according to Item 1 of article 76 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law), determine procedure for transportation of passengers, baggage and loads on air transport and are applied to all engineering procedures of airborne transportations of passengers, baggage and loads, including the servicing relating to them.

2. In case of accomplishment of international carriages these rules are applied in the part which is not contradicting the international treaties ratified by the Republic of Kazakhstan, and also to the legislation of the country in the territory from the territory or through the territory of which such transportations are performed.

3. In these rules the following concepts and terms are used:

1) airline - the legal entity having the air operator certificate of civil aircrafts;

2) the agent - the physical person or legal entity representing airline which is authorized direct it or from his name to act in case of accomplishment of all procedures connected with arrival, departure and registration of the aircraft of this airline, crew, passengers, baggage, load, mail and bortpripas;

3) the act of defects in transit baggage - (PIR - Property IrreguLarity Report), load (CIR - Carqo IrrequLarity Report) - the document processed by airline in the presence of the passenger (receiver) immediately after detection of the harm done to baggage (load) which transportation is made by aircrafts of one or several airlines which is signed by airline and the passenger (receiver);

4) the airport - the complex of constructions intended for acceptance and sending aircrafts, servicing of airborne transportations and having airfield, air terminal, other necessary constructions and the equipment for these purposes;

5) the airport (Item) of appointment - the airport (Item) to which the passenger, baggage or load, according to the agreement of airborne transportation is brought;

6) the airport (Item) of departure - the airport (Item) from which, according to the agreement of airborne transportation, transportation of the passenger, baggage or load begins;

7) the airport (Item) of transfer - the airport (Item) specified in the ticket or the freight bill in which according to the agreement of airborne transportation the passenger makes change or is performed transhipment of cargo from one flight to another for further following along transportation route;

8) baggage - the personal belongings of passengers or crew transported onboard the aircraft;

9) the baggage registered - baggage of the passenger which is accepted by airline for shipment under the responsibility for its safety and on which it issued the luggage receipt and luggage number label;

10) the baggage sent - the baggage sent not to destination because of airline;

11) baggage unclaimed - baggage which arrived to the airport (Item) of appointment specified in luggage label and was not received by the passenger;

12) baggage unregistered - baggage of the passenger, except registered, transported on the aircraft with the consent of Carrier, certified by label "Hand luggage" and placed in its luggage compartments and passenger salons. It is delivered aboard the aircraft by passengers. The unregistered baggage is transported under responsibility of the passenger, is subject to obligatory weighing on registration and enters regulation of free conveyance;

13) the ticket - (the passenger ticket and the luggage receipt) - the document for transportation issued by airline or his agents, certifying the conclusion of the contract with conditions of airborne transportation of the passenger;

14) the open ticket - the ticket in which are specified the point of departure appointments, airline, servicing class, but are not designated number of flight and date, aircraft departure time;

15) the order - the preliminary allocation on the aircraft of places for transportation of passengers, and also load amount for luggage transport and loads confirmed by electronic record in global distributive system of the airline containing flight and other information on the passenger, baggage or load with the assigned unique tsifrobukvenny code.
