About entering of amendments and changes into the Instruction on enforcement proceeding
Based on Item 11 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1605, the Ministry of Justice of the Republic of Belarus DECIDES:
1. Bring in the Instruction on enforcement proceeding approved by the resolution of the Ministry of Justice of the Republic of Belarus of December 20, 2004 No. 40 (The national register of legal acts of the Republic of Belarus, 2005, No. 2, 8/11871; 2011, No. 119, 8/24236), following amendments and changes:
1.1. to "claimant" to add Item 9 paragraph two after the word with words ", about the direction of the executive document in other court at the new place of residence (stay) or finding of the debtor, about suspension of enforcement proceeding";
1.2. in Item 10 part one:
after paragraph one to add with the paragraph of the following content:
"the direction of the executive document in other court in form according to appendix 31;";
to consider paragraphs of the second or seventh respectively paragraphs the third or eighth;
1.3. in Item 12:
the second after the paragraph of the eighth to add part with paragraphs of the following content:
"temporary restriction of the right of the debtor to departure from the Republic of Belarus according to the legislation;
temporary restriction of the right of the debtor - the citizen of the Republic of Belarus on control of motorized vehicles, on control of small size vessels, courts with outboard motors and hydrocycles, on hunting, except as specified need of use of these rights in connection with disability or as the single means of receipt of the income, - for the term established by court before obligation fulfillment, but no more than for five years;";
