About introduction of amendments to the Law of Ukraine "About television and broadcasting" concerning regulation of broadcast of programs and transfers with paid interactive tenders

The Verkhovna Rada of Ukraine decides:

1. Introduce in the Law of Ukraine "About television and broadcasting" (Sheets of the Verkhovna Rada of Ukraine, 2006, No. 18, Art. 155 with subsequent changes) such changes:

Article 6 after part two to add 1) with new part of such content:

"3. Broadcast of programs and transfers with interactive tenders (games, quizes) which conditions directly or mediately provide oplatny acquisition by person of the status of her participant and/or in which TV viewers and radio listeners for the purpose of receipt of prize in cash or property form for personal victory are offered to address the teleradio organization by any method (to perform phone call, to send the SMS message and so forth), which provides money recovery for connection and/or telephone conversation at the price which does not answer the tariff plan elected by the subscriber, or receipt of additional service of the operator of telecommunications who is not included in the list of the services provided by the agreement (tariff plan) is forbidden.

This prohibition does not extend on:

channels with limited access (broadcast channels on which by means of use of the coding devices and/or the software the open entry of subscribers to viewing of certain TV programs is limited so that acceptance of signal became impossible without decoder);

broadcast of programs and/or transfers per holding draws of lotteries;
