About enforcement of the Code of penal procedure of the Republic of Moldova

Art. 1. - The code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003 becomes effective since June 12, 2003.
Art. 2. - The criminal cases which are in stage of inquiry and pretrial investigation on the date of entry into force of the Code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003 fall under its provisions. Acts and the operations performed till this day according to the Code of penal procedure approved by the Law of the Moldavian SSR of March 24, 1961 with subsequent changes are valid.
Art. 3. - (1) provisions of the Code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003 are applied To the criminal cases which are in stage of judicial review in the first instance for June 12, 2003. Acts and the operations performed till this day according to the Code of penal procedure approved by the Law of the Moldavian SSR of March 24, 1961 with subsequent changes are valid. In case of change of cognizance of criminal cases they are given on cognizance for consideration on the merits, except for the cases which are in completion stage.
(2) If as a result of enhancement of system of degrees of jurisdiction of the judge are transferred to other degrees of jurisdiction or shall be dismissed during consideration of criminal cases which for June 12, 2003 will be in completion stage, their powers remain before completion of consideration of the these cases.
