About introduction of amendments and changes in the Law of the Kyrgyz Republic "About subsoil"

Accepted by Jogorku Kenesh of the Kyrgyz Republic on March 2, 2012

Article 1. Bring in the Law of the Kyrgyz Republic "About subsoil" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1997, No. 8, the Art. 377) the following amendments and change:

1. Add Article 3 with part 22 following of content:

"Historical costs - the total costs of last years incurred by the state on work on geological studying of the licensed territory and geological investigation of fields.".

2. Add the law with Article 4-1 of the following content:

"Article 4-1. Publicity of carrying out transactions on subsurface use

All interested persons, including legal entities and physical persons, representatives of state bodies of the power, local public administrations and local government bodies, have the right to get acquainted in authorized state body on subsurface use with conditions of provision of subsoil in use and its results.

All interested public associations which purpose is environmental protection have the right to the complete and reliable information relating to impact of the performed or planned operations on subsurface use to the environment, according to the procedure, determined by the Government of the Kyrgyz Republic.".

3. To state part 7 of Article 16 in the following edition:

"Licensing for right to use by object of subsoil and creation of the license agreement on designing of works between the licensor and the licensee are made by state body on subsurface use based on the solution of tender committee of the Government of the Kyrgyz Republic on competitive objects approved by the Government of the Kyrgyz Republic. In the license agreement payment terms of historical costs shall be stipulated. The cost of historical costs is estimated according to the rules approved by the Government of the Kyrgyz Republic.".
