1. SCOPE

This document determines procedure for issue of the instruction and application of penalties (further - procedure) for the violations revealed when carrying out the state control and supervision of observance of requirements of standards, rules of certification and behind the certified products (further - the state control and supervision), provided by the Laws of the Kyrgyz Republic "About standardization", "About certification of products and services", "About consumer protection", "About ensuring unity of measurements", "About modification and amendments in some legislative acts of the Kyrgyz Republic in edition of the Law "About Standardization" of 08.06.98 No. 76, of the Code of the Kyrgyz Republic about the administrative responsibility of June 18, 1998. The procedure extends to the territorial authorities of Kyrgyzstandart exercising the state control and supervision.

2. GENERAL PROVISIONS

2.1 Corrective actions for the violations revealed when carrying out the state control and supervision are applied by official lindens of Kyrgyzstandart and his territorial authorities:

2.2 The basis for issue of instructions and application of penalties are acts of the checks containing data on violations the requirement of standards and rules of certification.

2.3 In case of establishment of the violations provided by the Code of the Kyrgyz Republic about the administrative responsibility the state inspectors the protocol on administrative offense (the appendix L obligatory) is constituted.

2.4 The instruction in the form established by this procedure is issued to business entities by the Chief state inspectors and the state inspectors.

2.5 The decision on imposing of penalty and administrative punishments is accepted by the Chief state inspector of the Kyrgyz Republic and his deputy. Chief state inspectors and their deputies.

2.6 Kyrgyzstandart and his territorial authorities record the instructions issued by them and control their execution.
