About approval of the technical regulation of the Republic of Belarus "Packaged goods in packaging. Requirements to goods quantity and marking" (TP 2010/004/BY)

According to the paragraph the sixth article 8 of the Law of the Republic of Belarus of January 5, 2004 "About technical regulation and standardization" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed technical regulation of the Republic of Belarus "Packaged goods in packaging. Requirements to goods quantity and marking" (TP 2010/004/BY) (further - the technical regulation) and to enact it since January 1, 2013.

2. To the state committee on standardization:

bring the technical regulation to interested;

together with interested to develop and approve the actions plan on enforcement of the technical regulation.

3. Grant to the State committee on standardization the right to explain questions of application of the technical regulation.

4. To provide to republican state bodies till January 1, 2011 reduction of the technical regulatory legal acts in compliance with this resolution.

5. This resolution becomes effective from the date of its official publication.

The technical regulation of the Republic of Belarus "Packaged goods in packaging. Requirements to goods quantity and marking" (TP 2010/004/BY)

Article 1. Scope

This technical regulation extends to the released packaged goods in packaging of any kind regardless of method of their packing and country of source intended for market circulation of the Republic of Belarus.

Requirements of this technical regulation do not extend to the tobacco products, medicines applied in medical practice, veterinary medicines (medicines for animals) and products packed into transport container which in case of sale is weighed in the presence of the buyer.

This technical regulation establishes requirements to specifying of quantity of packaged goods, specifying of the price of unit of the packed-up goods, content of packing unit of the packed-up goods, batches of packaged goods, marking of packaged goods, and also to measuring vessels, held for use as consumer pack for liquid packaged goods, and their marking.

Article 2. Terms and determinations

For the purposes of this technical regulation the following terms and their determinations are applied:

the packing unit rejected in the content parameter - packing unit which valid value of goods quantity is less than minimum allowed value of content of packing unit;

the packing unit rejected in the "mass of main product in packaging without liquid" parameter - packing unit which valid value of mass of main product in packaging without liquid is less than minimum allowed value of mass of main product in packaging without liquid;

the valid value of goods quantity x (further - content) - goods quantity which actually contains in packaging;

the valid value of mass of main product in packaging without mosnmassa liquid of the main product in packaging which is really containing in packaging without the liquid circle;

the valid value of nominal capacity of measuring vessels - the actual amount of the liquid containing in measuring vessel of certain type when it is filled to the level corresponding to nominal capacity;

the valid value of complete capacity of measuring vessels - the actual amount of the liquid containing in measuring vessel of certain type when it is filled to the level corresponding to complete capacity (to edge of nimbus of measuring vessel);

the manufacturer of measuring vessels - the legal entity, including foreign, or the individual entrepreneur, performing on its own behalf production of measuring vessels for their subsequent realization and responsible for their compliance to requirements imposed to measuring vessels;

the manufacturer of packaged goods - the legal entity, including foreign, or the individual entrepreneur, performing on its own behalf production with packing or without packing and (or) packing of packaged goods for their subsequent realization and responsible for their compliance to requirements imposed to packaged goods;

the importer of measuring vessels - resident of the Republic of Belarus which signed with the nonresident of the Republic of Belarus the agreement in foreign trade on transfer of measuring vessels performs import to the Republic of Belarus and realization of the measuring vessels made outside the republic and bears responsibility for their compliance to requirements imposed to measuring vessels;

the importer of packaged goods - resident of the Republic of Belarus which signed with the nonresident of the Republic of Belarus the agreement in foreign trade on transfer of packaged goods performs import to the Republic of Belarus and realization of the packaged goods made outside the republic and bears responsibility for their compliance to requirements imposed to packaged goods;

the combined packaged goods - the goods in group container consisting of several packing units with goods of one or different types and names and (or) products which are separately not intended for independent market circulation;

marking - information placed on packaging (the label, label) of packaged goods or it is direct on measuring vessels for ensuring their identification;

measuring vessels - the consumer pack of certain type for liquid packaged goods having the bottle form, made of glass or another the transparent, keeping form material with indication of in marking of value of nominal capacity which amount and capacity are known and so permanent that the amount of the liquid which is in it can be determined with sufficient accuracy without carrying out measurements;

the nominal mass of main product in packaging without mosn liquid. number - the mass of the main component of the foodstuff which is in the liquid circle, without the mass of the liquid circle (water, salty water, brine, vinegar, sugar solution in water, solution of other sweeteners in water, fruit or vegetable juice, etc.), specified on packaging;

nominal goods quantity Kn - the goods quantity specified in marking of packaged goods on packaging (label, the label);

the address of packaged goods in the market - the movement of packaged goods from the manufacturer (packer) and (or) the importer to the consumer covering all processes which take place packaged goods after completion of their production;

the address of measuring vessels in the market - the movement of measuring vessels from the manufacturer (packer) and (or) the importer to the manufacturer of packaged goods covering all processes which take place measuring vessels after completion of their production;

negative variance of content from nominal goods quantity (daleeotritsatelny variation of content) - the valid number of investment shortage of goods in packing unit;

negative variance of the valid value of mass of main product in packaging without liquid from the nominal mass of main product in packaging without liquid (further - negative variance of the valid value of mass of main product in packaging without liquid) - the valid number of investment shortage of main product in packing unit;

batch of measuring vessels - the measuring vessels of the same type having the same sizes and capacity made by the same legal entity or the individual entrepreneur and intended to simultaneous delivery, acceptance, survey and quality standard (in case of production of measuring vessels) or intended for import (when importing measuring vessels);

batch of packaged goods - the packaged goods of the same name having the same appearance and type of packaging (for packaged goods with identical nominal goods quantity - the same value of nominal goods quantity) and packing method, made and (or) packed by the same legal entity or the individual entrepreneur and intended to simultaneous delivery, acceptance, survey and quality standard (in case of production of packaged goods or their packing) and (or) intended for placement or market circulation;

complete capacity of measuring vessels of Vmspoln - liquid amount which contains measuring vessel of certain type when filling it in normal conditions to edge of nimbus;

consumer goods - the goods intended for the personal, domestic, family and other needs which are not connected with implementation of business activity;

limit of permissible deviations of the valid value of nominal [complete] capacity of measuring vessels from the nominal [complete] capacity of measuring vessels P (further - limit of permissible deviations of capacity of measuring vessels) - the greatest allowed difference (positive or negative) between the valid value of nominal [complete] capacity of measuring vessel determined at temperature of liquid 20,0 + 0,1, C and the value of nominal [complete] capacity of measuring vessel of certain type given in technical regulatory legal act or other document on measuring vessels and specified in their marking;

engineering measuring supervision of packaged goods - the control exercised and which is documentary drawn up by metrological services or other structural divisions of the manufacturer (the packer, the importer) of packaged goods on check of observance of the technical requirements imposed to packaged goods using measuring instruments and auxiliary devices;

engineering supervision of measuring vessels - the control exercised and which is documentary drawn up by the manufacturer (importer) of measuring vessels on check of observance of the technical requirements imposed to measuring vessels;
