About acts of civil status
The Parliament adopts this organic law.
This law determines:
a) bodies, authorized to register acts of civil status;
b) order of registration of the facts and events of civil status;
b 1) procedure for issue of documents on civil registration;
c) procedure for change, correction, recovery and cancellation of civil registrations, and also entering of marks into them;
d) procedure for forming of registers (further - registers of acts of civil status);
e) procedure and storage durations of registers of acts of civil status.
The legislation on acts of civil status includes this law based on provisions of Civil and Family codes and also other regulations adopted according to it.
(1) Civil registrations are the state registration records by means of which the facts and events influencing origin, change or the termination of the rights and obligations of citizens are confirmed legal status of the last is characterized.
(2) Legal effects cause only the facts and events of civil status subjected to state registration by bodies of the Republic of Moldova authorized to register acts of civil status (further - authorized bodies).
(3) the Facts and events of civil status made on religious practices to organization or recovery of authorized bodies of the Republic of Moldova and registered according to the legislation existing for date of their making or approach are recognized valid without requirement of their registration authorized bodies.
(4) the Facts and events of civil status registered in other states are recognized and attract legal effects in the territory of the Republic of Moldova according to this law.
(1) State registration of the facts and events of civil status is made for the purpose of protection of the property and personal non-property rights of citizens, and also for the purpose of protection of interests of the state.
(2) State registration of the facts and events of civil status is made on behalf of the state by authorized bodies, stipulated in Article 14.
(3) State registration of the facts and events of civil status is made by means of one of the following procedures:
a) primary registration;
b) registration after fixed term;
c) recovery;
d) the certificate of the facts and events of civil status taking place and which are drawn up in left bank of Dniester and Bender's municipium;
e) record of the facts and events of civil status taking place in other states.
(4) the following facts and events of civil status are subject to State registration:
a) birth;
b) marriage;
c) annulment of marriage (divorce);
d) change of surname and/or name;
e) death;
f) recognition, establishment or contest of paternity;
g) establishment and termination of adoption (adoption).
(5) State registration of recognition of paternity, paternity proof and establishment or the termination of adoption (adoption) is made depending on circumstances by modification of record of the act of civil status about the birth.
(1) Provision of services according to acts of civil status is performed owing to powers or according to the statement with representation in need of the documents confirming approach of the facts and events of civil status, which are subject to registration.
(2) State registration of the facts and events of civil status, change and cancellation of civil registrations, and also provision of the related state services, including services which require urgency are made in terms and according to the procedure established by the Government.
(3) the Application for provision of services according to acts of civil status is submitted depending on circumstances electronically or on paper according to the procedure and on the conditions provided by the law and other regulations.
(4) Provision of services according to acts of civil status is performed only in connection with the facts and events of civil status which took place during the period established as the legal term of temporary storage of registers of acts of civil status in divisions of public organization "Agency of the State Services" (further - the Agency of the state services).
(5) In case of provision of services according to acts of civil status the identity of the applicant or depending on circumstances of the applicant, and also reliability of the provided data are checked by their comparison to data of the state information resources, and also by consideration of the documents on civil registration submitted by the applicant and other documents including issued by bodies of other states.
(6) the Responsible person in the representative to register acts of civil status body has no right to register the act of civil status if it is the party of this act or the applicant. In such cases powers are delegated to other person according to the legislation.
(7) State registration and issue of documents on civil registration are performed in Romanian. Documents on civil registration can be issued on multilingual forms, including in transfer on standard multilingual forms.
(8) Surnames and names are transferred from civil registrations, from identity documents, and in cases when it is impossible to provide proofs of state registration of the facts and events of civil status, - from other documents submitted by the applicant or depending on circumstances the applicant or received from the bodies provided by the law.
