About entering of amendment and changes into the Instruction about procedure for making of notarial actions

Based on Item 11 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1605, the Ministry of Justice of the Republic of Belarus DECIDES:

1. Bring in the Instruction about procedure for making of notarial actions approved by the resolution of the Ministry of Justice of the Republic of Belarus of October 23, 2006 No. 63 (The national register of legal acts of the Republic of Belarus, 2006, No. 188, 8/15268; 2011, No. 55, 8/23626; No. 128, 8/24391), the following amendments and changes:

1.1. to add the paragraph of the sixth part one of Item 256 with words "(the copy of notarially certified document certified by the notary according to the procedure, established by part two of Item 14 of this Instruction if collection is made in parts)";

1.2. the first offer of part two of Item 257 to state in the following edition:

"If debt collection is made in parts, then on the document confirming the obligation of the debtor the mark about making of executive text with indication of the amount which is subject to collection, the period for which collection, dates and numbers at which the executive text is registered in the register for registration of notarial actions is made becomes.";

1.3. state Item 258 in the following edition:

"258. On each debt obligation one executive text is made, except as specified, when debt collection on this debt obligation is made in parts. In case of debt collection on joint liability in executive text several solidary debtors can be specified. In the text of executive text the information about solidary debtors according to part two of Item 255 of this Instruction is specified.

If other is not established by this Instruction, the executive text is made in duplicate, one them who are stored in cases of office of notary public (the private notary), the second - is issued to the claimant.
