About modification and amendments in some legal acts

Art. I. - In the Law on conflict of interest No. 16-XVI of February 15, 2008 (Official monitor of the Republic of Moldova, 2008, No. 94-96, of the Art. 351), with subsequent changes, to make the following changes:

1. State Article 23 in the following edition:

"Article 23. Gifts and other benefits

(1) Persons specified in Article 3, are forbidden to ask or accept the gifts, services, privileges, offers or any other benefits intended for them personally or for their families.

(2) the Prohibition determined by part (1), it is not applied to symbolical gifts, gifts received according to regulations of politeness or within the hospitality events which cost does not exceed the limits set by the Government.

(3) Gifts which cost exceeds the set limits, are transferred to the order of the relevant public organization and register in the special magazine which is kept each public organization which information is open. If person specified in Article 3, pays the cost of the thing received as gift, it can keep gift with indication of this fact in the magazine under list.

(4) the Evaluation procedure, accounting, storage, use and the redemption of gifts is regulated by the Government.

(5) If the gift, service, privilege, the offer or any other not receivable benefit is offered to person specified in Article 3,, then for the purpose of ensuring the protection it shall take the following measures:

a) refuse not receivable benefit; for its use further as the proof to accept it there is no need;

b) try to have witnesses, including colleagues from service;

c) describe as much as possible in detail these actions in the special magazine;

d) to report immediately on such attempt on competent authorities;

e) continue work properly, in particular that in connection with which not receivable benefit was offered.".

2. State Article 251 in the following edition:

"Article 251. Responsibility for violation of provisions of this law

(1) Violation of provisions of this law is punished according to Code regulations on offenses or the Criminal code.
