About introduction of amendments to some orders of Fund of state-owned property of Ukraine

According to article 5 of the Law of Ukraine "About Fund of state-owned property of Ukraine", the Law of Ukraine of January 13, 2012 to No. 4336-VI "About introduction of amendments to some laws of Ukraine concerning privatization concerning realization of provisions of the State program of privatization for 2012-2014", for the purpose of reduction of regulatory legal acts of Fund of state-owned property of Ukraine in compliance with requirements of the current legislation I ORDER:

1. In the order of Fund of state-owned property of Ukraine of October 30, 2001 No. 1996 "About approval of the Regulations on the procedure for training of the physical persons who were trained according to the program of basic training of appraisers", registered in the Ministry of Justice of Ukraine on November 15, 2001 for No. 956/6147:

1.1. In the title and Item 1 of the order of the word of "the appraisers who were trained according to the program of basic preparation" shall be replaced with words "for receipt of the certificate of competency of the appraiser".

1.2. In preamble of the order of the word of "the appraisers who were trained according to programs of basic preparation" shall be replaced with words "for receipt of the certificate of competency of the appraiser".

2. In the order of Fund of state-owned property of Ukraine of December 19, 2001 No. 2357 "About the approval of the Procedure for test of documents of the public organization applying for recognition of the status of the self-regulating organization of appraisers", registered in the Ministry of Justice of Ukraine on January 11, 2002 for No. 25/6313:

2.1. To state the title of the order in the following edition:

"About approval of the Procedure for test of documents of the public organization (merging of public organizations) applying for recognition of the status of the self-regulating organization of appraisers (merging of the self-regulating organizations of appraisers)".

2.2. To state Item 1 of the order in the following edition:

"1. Approve the Procedure for test of documents of the public organization (merging of public organizations) applying for recognition of the status of the self-regulating organization of appraisers (merging of the self-regulating organizations of appraisers) which is applied.".

3. Approve Changes to some regulatory legal acts of Fund of state-owned property of Ukraine which are attached.

4. Declare invalid the order of Fund of state-owned property of Ukraine of May 08, 2002 No. 791 "About approval of the Operating procedure of the Supervisory board concerning estimative activities", registered in the Ministry of Justice of Ukraine on June 04, 2002 for No. 477/6765 (with changes).

5. Determine that:

certificates of subjects of estimative activities for the directions and specializations which in them are specified, issued before entry into force of this order are effective during the term specified in them;

the physical persons who received qualification documents of appraisers according to the procedure which was effective before entry into force of the Law of Ukraine "About assessment of property, property rights and professional estimative activity in Ukraine", and according to Item 5 of the Section VII of the specified Law registered in the State register of appraisers are considered passed training according to requirements of the Law of Ukraine "About assessment of property, property rights and professional estimative activity in Ukraine".

6. To provide to the head of department concerning estimative activities provision of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

7. To impose control over the implementation of the order on the director of the department of coordination of development and accomplishment of program documents, assessment and the order objects of state-owned property.

8. This order becomes effective from the date of its official publication.

Changes to some regulatory legal acts of Fund of state-owned property of Ukraine

1. In Regulations on procedure for agreement signature on the cooperation on professional training of appraisers approved by the order of Fund of state-owned property of Ukraine of October 29, 2001 No. 1977, registered in the Ministry of Justice of Ukraine on November 15, 2001 for No. 955/6146:

1.1. In the Section I:

in Item 1 of the word and figures of "Article 14" shall be replaced with words "the Law of Ukraine "On Fonda of state-owned property of Ukraine"";

"the organizations of appraisers" to add Item 6 after words with words "their associations".

1.2. In the Section II:

in Item 8 of the word "are approved by the Supervisory board concerning estimative activities" shall be replaced with words and in figures "it is established by the order of Fund of state-owned property of Ukraine of April 15, 2004 No. 754 "About approval of General requirements to training programs of training of appraisers and increases in their qualification", registered in the Ministry of Justice of Ukraine on May 05, 2004 for No. 562/9161";

in the first offer of paragraph one of Item 9 of the word "after approval by the Supervisory board concerning estimative activities" to exclude;

the second offer of paragraph two of Item 11 to add with the words "except cases when the training took place before training and/or the physical person acquired the right to implementation of estimative activities for other directions earlier";

add Item 12 with words and figures "taking into account Item 11 of this provision";

to add Item 18 paragraph two after words of "the organizations of appraisers" with words of "their associations", words and figure "as a part of at least 9 people" shall be replaced with words "scientists, specialists in the field of estimative activities";

in the first offer of Item 19 of the word "vice-chairman of the Commission" shall be replaced with words "person authorized by the Chairman FGIU under whose supervision the relevant structural division to which powers questions according to property belong, property rights and professional estimative activity is";

the first offer of Item 20 to state in such edition: "Quantitative and staff of the Commission affirm the Chairman of FGIU";

the paragraph one of Item 22 after words "the organizations of appraisers" to add with words "their associations";

the first offer of Item 26 after words of "the decision of the Commission" to add with the words "has advisory nature and";

add the Section with new Item 27 of the following content:

"27. Following the results of consideration of the protocol provided by the Commission, the report on check of work of educational institutions (analytical materials), results of testing the Fund of state-owned property makes relevant decisions.".

With respect thereto to consider Items 27-31 respectively Items 28-32.

1.3. In the paragraph the second Item 31 of the Section III of figure and the word "28 and 29" to replace with figures and the word "29 and 30".

1.4. 1, 2 to the Provision to state appendices in the following edition:

     I. По таким направлениям базовой подготовки оценщиков(1):

     1. Оценка объектов в материальной форме:

     а) оценка    недвижимых    вещей    (недвижимого   имущества,

недвижимости), в том числе земельных участков и имущественных прав 

на них;

     б) оценка машин и оборудования;

     в) оценка колесных транспортных средств;

     ґ) оценка летательных аппаратов;

     г) оценка судоходных средств;

     д) оценка движимых вещей, составляющих культурную ценность;

     е) оценка движимых вещей,  кроме таких,  которые  отнесены  к 

машинам,  оборудованию,  колесным   транспортным        средствам,  

летательным  аппаратам, судоходным средствам и тех,        которые 

составляют культурную ценность.

     2. Оценка   целостных  имущественных комплексов, паев, ценных 

бумаг,   имущественных прав и невещественных активов,  в том числе 

оценка прав на объекты интеллектуальной собственности:

     а) оценка  целостных   имущественных комплексов, паев, ценных 

бумаг, имущественных прав и  нематериальных активов (кроме  оценки  

прав  на объекты интеллектуальной собственности);

     б) оценка прав на объекты интеллектуальной собственности.

     3. Оценка для целей налогообложения  и  начисления  и  уплаты

других обязательных платежей, которые производятся  в соответствии 

с законодательством:

     а) оценка    недвижимых    вещей   (недвижимого    имущества,  

недвижимости) физических лиц, в  том числе земельных   участков, и 

имущественных прав на них, включая  объекты недвижимого  имущества 

(недвижимости) физических лиц в значениях, приведенных в Налоговом  

кодексе  Украины,
