About approval of the Procedure for access and accession to the Single gas-transport system of Ukraine

According to the Law of Ukraine "About the principles of functioning of the natural gas market", the Presidential decree of Ukraine of 23.11.2011 No. 1059 "About the National commission performing state regulation in the field of power" the National commission performing state regulation in the field of power DECIDES:

1. Approve the Procedure for access and accession to the Single gas-transport system of Ukraine which is applied.

2. In accordance with the established procedure to provide to management of regulation of oil and gas complex provision of this resolution on state registration in the Ministry of Justice of Ukraine.

3. This resolution becomes effective from the date of its official publication.

Procedure for access and accession to single gas-transport system of Ukraine

I. General provisions

1.1. This Procedure is developed according to the Laws of Ukraine "About the principles of functioning of the natural gas market", "About metrology and metrological activities", "About pipeline transport", "About oil and gas", "About natural monopolies", "About ensuring commercial accounting of natural gas" and other regulatory legal acts.

1.2. Action of this Procedure extends to physical persons, legal entities and physical persons - the entrepreneurs performing economic activity on production, transportation, distribution, storage and/or supply of natural gas, irrespective of their subordination and pattern of ownership, and also using natural gas as fuel or raw materials (further - subjects of the natural gas market).

1.3. In this Procedure the terms below are used in such value:

the owner of gas networks - legal entity or physical person or physical litsopredprinimatel who possesses on the property right or uses of network of the gas company, gas or high-level networks and constructions on them;

measurement of amount of gas - the continuous procedure of determination by means of metering stations of natural gas of amount of gas which passes through the cross section of the gas pipeline;

production and technological expenses and normative losses gazanormativny amount of natural gas which is spent for implementation of engineering procedures in case of production, preparation for transfer to EGTSU, transportation, distribution and storage (pumping, storage, selection) of natural gas, within EGTSU;

free throughput of the gas pipeline or its site - difference between the technically feasible (optimum) throughput of EGTSU or its certain site during certain period of time and transportation loads of natural gas, zakontraktirovanny for this period, all subjects of the natural gas market;

metering station of natural gas (metering station) - set of means of the measuring equipment and the supportive applications intended for measurement, registration of results of measurement and calculations of amount of the natural gas given to standard conditions;

resource shortage of natural gas (deficit) - the negative difference between the planned and actually delivered amounts of natural gas which arose at the supplier during calendar month;

imbalance of amounts of gas - amount of gas which is determined for the certain customer of transportation service or to gas distribution as difference between the actual amounts of its transfer to EGTSU and the actual amounts of its selection from EGTSU;

access to the Single gas-transport system of Ukraine - set of the services necessary for subjects of the natural gas market for implementation of the economic activity connected with use of natural gas;

duplicative metering station - the metering station intended for control of amount of natural gas which is considered by the metering station;

duplicative SIT - the means of the measuring equipment intended for control of operability of the similar SIT which is part of the metering station;

examination of means of the measuring equipment - complex of actions which are performed for the purpose of data acquisition concerning compliance of the means of the measuring equipment (MME) to metrological characteristics and conditions of their installation and operation, integrity of seals which oplomborovyvatsya SIT, and compliance of marking of seals;

substitution - the process connected with features of functioning of EGTSU in case of which supply of natural gas is performed irrespective of availability of physical capacity of transportation of natural gas from point of entry to point of its exit. At the same time natural gas of one owner (origin) can be used by the second owner on condition of receipt of equivalent amount of natural gas for this owner in other point of entry in EGTSU;

the means of the measuring equipment (MME) - the technical tool which is used during measurements and has the normalized metrological characteristics;

the statement - the address of the subject of the natural gas market (customer) stated in writing transferred to the Operator of the Single gas-transport system of Ukraine (further - the Operator), the ODS, GTP (or GP), concerning provision to the customer of services of access or accession to EGTSU, including or at least one of such services:

inclusion in the List of all subjects of the natural gas market (their objects) and receipt of the right to use information by them from the List;

transportation of the MG and/or SGDP natural gas;

distribution of the GRS natural gas;

pumping of natural gas in UGS, its storage and selection from UGS;

accession of objects of system of gas consumption (gas supply) of the customer to the high-level or gas distribution networks;

the gas metering station - metering station which is applied to carrying out commercial calculations when implementing transportation, distribution and supply of natural gas;

commercial accounting of gas - determination in point of commercial accounting of gas of amount of the transferred (accepted) gas for registration by agreement parties (the technical agreement), delivery-acceptance certificates (provision of services, the reporting) for carrying out commercial settlement;

commercial balancing - the actions connected with documentary registration of actual receipt and the actual distribution of amounts of natural gas in MG or GRS for month under report in accordance with the terms of the signed contracts between subjects of the natural gas market;
